TITLE OF BILL:

An act to amend the highway law, in relation to designating a portion of
the state highway system the "John 'Jody' Rossitz Memorial Bridge"

 
PURPOSE:

This bill relates to designating the bridge on state route 28 over the
Esopus creek in the town of Shandaken, county of Ulster, as the "John
'Jody' Rossitz Memorial Bridge".

 
SUMMARY OF PROVISIONS:

Section one of this legislation amends the highway law by adding a new
section 344-L so that the bridge across Esopus Creek on state route 28
between Creek Side Drive and Church Road in the town of Shandaken,
Ulster County shall be designated and known as the "John 'Jody' Rossitz
Memorial Bridge". Section two of the bill states the commissioner of

transportation shall provide for the installation and maintenance of
adequate signing of the state highway system as designated pursuant to
section one of this act.  Section two also clarifies that the desig-
nation of this bridge shall be one of ceremonial nature and the official
name of bridge will not be changed as a result of this act. Section
three provides for an immediate effective date.

 
JUSTIFICATION:

John "Jody" Rossitz passed away in March of 2018, leaving behind a lega-
cy of service and compassion in his community.  Mr. Rossitz lived in
Oliverea within Shandaken most of his life, raising his family there and
contributing in every conceivable way to his community. He served 34
years as a volunteer member and eventual Chief of the Big IndianOliverea
Fire Department. Mr. Rossitz served his community greatly as fire chief,
running to the aid of any individual in need. He was also well respected
throughout the volunteer firefighter community, always providing guid-
ance and lending a hand when other Departments were in need. During
Hurricane Irene in 2011, he was instrumental in organizing recovery
efforts for the Oliverea Valley, one of the most severely hit hamlets
after the storm. Renaming the new replacement bridge being constructed
on Route 28 would honor the dedication he showed through service to his
community.

 
FISCAL IMPLICATIONS:

This legislation would effectively have no fiscal impact on state and
local governments. The New York State Department of Transportation would
be required to develop signage to mark the bridge.

 
EFFECTIVE DATE:
This act shall take effect immediately.

 AN ACT to amend the highway law, in relation to designating a portion of

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The highway law is amended by adding a new section 344-m to
 read as follows:
   § 344-M. PORTION OF THE STATE HIGHWAY SYSTEM TO BE DESIGNATED  AS  THE
 "JOHN  'JODY'  ROSSITZ MEMORIAL BRIDGE". THE BRIDGE OVER ESOPUS CREEK ON
 STATE ROUTE TWENTY-EIGHT BETWEEN CREEK SIDE DRIVE AND CHURCH ROAD IN THE
 TOWN OF SHANDAKEN, COUNTY OF ULSTER, SHALL BE DESIGNATED  AND  KNOWN  AS
 THE "JOHN 'JODY' ROSSITZ MEMORIAL BRIDGE".
   §  2. The commissioner of transportation shall provide for the instal-
 lation and maintenance of adequate signing of the state  highway  system
 as  designated  pursuant  to  section one of this act. However, to avoid
 confusion and to limit any possible disruption of commerce,  the  desig-
 nation  called  for  pursuant to section one of this act shall be one of
 ceremonial nature and the official name of  such  bridge  shall  not  be
 changed as a result of this act.
   § 3. This act shall take effect immediately.
