 Introduced  by Sen. MARTUCCI -- read twice and ordered printed, and when
   printed to be committed to the Committee on Rules
 
 AN ACT to prohibit day care centers from requiring children ages five or
   under to wear face coverings or face masks
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Notwithstanding any other provision law, rule, regulation
 or other directive to the contrary,  no  state  licensed  or  registered
 child  care  centers,  home-based  group  family  and  family child care
 programs, or after-school child care programs shall require, as a condi-
 tion of receiving any service or entering any place, any  child  who  is
 five  years  of age or younger to wear a face covering or face mask when
 such purpose for wearing the covering or mask is related to the COVID-19
 virus.
   § 2. This act shall take effect immediately.
