BILL NUMBER: S7506 SPONSOR: ADDABBO TITLE OF BILL: An act to amend the insurance law, in relation to coverage for prenatal vitamins SUMMARY OF PROVISIONS: Section 1. Describes which individual medical policies must provide coverage for prenatal vitamins. Coverage of the prenatal vitamins are subject to annual deductibles and coinsurance that are consistent with those established for a given policy. Section 2: Describes which group or blanket medical policies must provide coverage for prenatal vitamins. Coverage of the prenatal vita- mins are subject to annual deductibles and coinsurance that are consist- ent with those established for a given policy.' Section 3. States that every contract issued by a corporation which provides coverage for prescription drugs shall provide coverage for prenatal vitamins. This coverage will be subject to deductibles and

ADDABBO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the insurance law, in relation to coverage for prenatal vitamins THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subsection (i) of section 3216 of the insurance law is amended by adding a new paragraph 10-a to read as follows: (10-A)(A) EVERY POLICY WHICH PROVIDES COVERAGE FOR PRESCRIPTION DRUGS SHALL PROVIDE COVERAGE FOR PRENATAL VITAMINS WHEN PRESCRIBED OR ORDERED BY A HEALTH CARE PROVIDER LEGALLY AUTHORIZED TO PRESCRIBE UNDER TITLE EIGHT OF THE EDUCATION LAW. (B) SUCH COVERAGE MAY BE SUBJECT TO ANNUAL DEDUCTIBLES AND COINSURANCE AS MAY BE DEEMED APPROPRIATE BY THE SUPERINTENDENT AND AS ARE CONSISTENT WITH THOSE ESTABLISHED FOR OTHER BENEFITS WITHIN A GIVEN POLICY. § 2. Subsection (k) of section 3221 of the insurance law is amended by adding a new paragraph 5-a to read as follows: (5-A)(A) EVERY GROUP OR BLANKET POLICY WHICH PROVIDES COVERAGE FOR PRESCRIPTION DRUGS SHALL PROVIDE COVERAGE FOR PRENATAL VITAMINS WHEN PRESCRIBED OR ORDERED BY A HEALTH CARE PROVIDER LEGALLY AUTHORIZED TO PRESCRIBE UNDER TITLE EIGHT OF THE EDUCATION LAW. (B) SUCH COVERAGE MAY BE SUBJECT TO ANNUAL DEDUCTIBLES AND COINSU- RANCE, AS MAY BE DEEMED APPROPRIATE BY THE SUPERINTENDENT AND AS ARE CONSISTENT WITH THOSE ESTABLISHED FOR OTHER BENEFITS WITHIN A GIVEN POLICY. § 3. Section 4303 of the insurance law is amended by adding a new subsection (c-1) to read as follows: (C-1)(1) EVERY CONTRACT ISSUED BY A CORPORATION SUBJECT TO THE PROVISIONS OF THIS ARTICLE WHICH PROVIDES COVERAGE FOR PRESCRIPTION DRUGS SHALL PROVIDE COVERAGE FOR PRENATAL VITAMINS WHEN PRESCRIBED OR EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
