BILL NUMBER: S7730 SPONSOR: SKOUFIS TITLE OF BILL: An act to amend the real property law, in relation to increasing required training for real estate brokers and real estate salespeople to prevent discrimination; and to amend a chapter of the laws of 2021 amending the real property law relating to increasing required training for real estate brokers and real estate salespeople to prevent discrimi- nation, as proposed in legislative bills numbers A. 5359 and S. 2132-B, relating to the effectiveness thereof PURPOSE: This is a chapter amendment to L.2021, c.697, to clarify provisions concerning mandatory anti-discrimination training for real estate professionals. SUMMARY OF PROVISIONS: This legislation amends two provisions of L. 2021, c. 697.

SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the real property law, in relation to increasing required training for real estate brokers and real estate salespeople to prevent discrimination; and to amend a chapter of the laws of 2021 amending the real property law relating to increasing required train- ing for real estate brokers and real estate salespeople to prevent discrimination, as proposed in legislative bills numbers A. 5359 and S. 2132-B, relating to the effectiveness thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (ii) of paragraph (c) of subdivision 3 of section 441 of the real property law, as amended by a chapter of the laws of 2021 amending the real property law relating to increasing required training for real estate brokers and real estate salespeople to prevent discrimination, as proposed in legislative bills numbers A. 5359 and S. 2132-B, is amended to read as follows: (ii) The secretary of state shall require approved faculty to sign AND AFFIRM, UNDER PENALTY OF PERJURY, a document [under oath], approved by and submitted ELECTRONICALLY to the department of state, attesting to compliance with all applicable statutory and regulatory requirements pertaining to the instruction of the established curriculum. The secre- tary of state shall promulgate penalties for faculty that fail to meet the obligations required under this section and department of state regulations including, but not limited to, the temporary suspension of their instructor certificate for the first such failure and the revoca- tion of their instructor certificate for any subsequent failure. § 2. Section 5 of a chapter of the laws of 2021 amending the real property law relating to increasing required training for real estate brokers and real estate salespeople to prevent discrimination, as proposed in legislative bills numbers A. 5359 and S. 2132-B, is amended to read as follows: § 5. This act shall take effect [on the first of July next succeeding the date on which] ONE YEAR AFTER it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
