TITLE OF BILL:

An act to amend the alcoholic beverage control law, in relation to the
sale of prepared liquor drinks

 
PURPOSE:

Allow for the sale of ready to draft cocktails

 
SUMMARY OF PROVISIONS:

Adds a new paragraph (c ) to section 106 of the ABC law to permit the
preparation and on premise consumption of alcohol beverages that have
been mixed inside a sealed PET vessel, with a capacity greater than a
gallon and dispensed by a pressurized draft system by a retail licensee.

 
EXISTING LAW:

              

Section 106 of the Alcoholic Beverage Control law presently prohibits
the storage of alcoholic beverages in anything other than the original
container or drinks prepared and kept in dispensing machines, having
capacities of not less than a gallon, which continually mix such drinks.

 
JUSTIFICATION:

NYS Alcohol and Beverage Control Law currently blocks the ability to
serve beverages meeting higher food safety and sanitation levels there-
fore the law needs to be updated for advances in technology.

Newer systems where liter bottles of spirits are added to recyclable,
tamper proof, airtight kegs with mix to create cocktails, which are
then, be dispensed by tap. The benefits of these systems are:

 *pressurized with CO2 or nitrogen prevents growth of aerobic bacteria;
 *produced mixes have the required preserving agents that onsite
produced beverages lack; and,
 *commercially produced beverages are refined to the level that they are
colloid homogenous mixtures that do not require agitation.
