BILL NUMBER: S7761 SPONSOR: SAVINO TITLE OF BILL: An act to amend the social services law, in relation to making care and services provided by licensed mental health counselors and marriage and family therapists eligible for coverage under the Medicaid program PURPOSE: This is a chapter amendment that makes changes to provisions of L.2021, c.819, to allow mental health counselors and marriage and family counse- lors licensed under Article 163 of the Education law to bill Medicaid directly for their services. SUMMARY OF PROVISIONS: This legislation amends the underlying chapter by changing mental health practitioners to mental health counselors and adds marriage and family therapists to the list of providers covered under the bill. Addi- tionally, it removes creative art therapists and psychoanalysts.

SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the social services law, in relation to making care and services provided by licensed mental health counselors and marriage and family therapists eligible for coverage under the Medicaid program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (gg) of subdivision 2 of section 365-a of the social services law, as added by a chapter of the laws of 2021 amending the social services law relating to making care and services provided by licensed mental health practitioners eligible for coverage under the Medicaid program, as proposed in legislative bills numbers S. 6575 and A. 6323, is amended to read as follows: (gg) care and services provided by mental health [practitioners] COUN- SELORS AND MARRIAGE AND FAMILY THERAPISTS licensed pursuant to article one hundred sixty-three of the education law acting within their scope of practice, where such services would otherwise be covered under this title. Nothing in this paragraph shall be construed to modify or expand the scope of practice of a mental health counselor[,] OR marriage and family therapist[, creative arts therapist or psychoanalyst] licensed pursuant to article one hundred sixty-three of the education law. § 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2021 amending the social services law relating to making care and services provided by licensed mental health practitioners eligible for coverage under the Medicaid program, as proposed in legislative bills numbers S. 6575 and A. 6323, takes effect.
