BILL NUMBER: S7803 SPONSOR: SKOUFIS TITLE OF BILL: An act to amend the public officers law, in relation to amending the definition of a "public body" PURPOSE: This is a chapter amendment that makes changes to provisions of L.2021, c.676, to clarify the definition of "public body" for purposes of the Open Meetings Law. SUMMARY OF PROVISIONS: Section 1 of this legislation clarifies that a committee or subcommittee of a public body must have two or more members and require a quorum to function in order to be classified as a public body. Section 2 makes this change effective on the same date and in the same manner as a chapter of the laws of 2021 amending the public officers law

SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public officers law, in relation to amending the definition of a "public body" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 102 of the public officers law, as amended by a chapter of the laws of 2021 amending the public officers law relating to amending the definition of a "public body", as proposed in legislative bills numbers S. 1625-a and A. 924-a, is amended to read as follows: 2. "Public body" means any entity, for which a quorum is required in order to conduct public business and which consists of two or more members, performing a governmental function for the state or for an agency or department thereof, or for a public corporation as defined in section sixty-six of the general construction law, or committee or subcommittee or other similar body consisting of members of such public body, or an entity created or appointed to perform a necessary function in the decision-making process FOR WHICH A QUORUM IS REQUIRED IN ORDER TO CONDUCT PUBLIC BUSINESS AND WHICH CONSISTS OF TWO OR MORE MEMBERS. A necessary function in the decision-making process shall not include the provision of recommendations or guidance which is purely advisory and which does not require further action by the state or agency or depart- ment thereof or public corporation as defined in section sixty-six of the general construction law. § 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2021 amending the public officers law relating to amending the definition of a "public body", as proposed in legislative bills numbers S. 1625-a and A. 924-a, takes effect.
