BILL NUMBER: S7845 Revised 1/13/2022 SPONSOR: MYRIE TITLE OF BILL: An act to amend chapter 249 of the laws of 2021, amending the election law relating to electronic applications for absentee ballots, in relation to the effectiveness thereof; and to amend a chapter of the laws of 2021, amending the election law relating to establishing an electronic absentee ballot application transmittal system, as proposed in legislative bills numbers S. 6482-B and A. 6970-A, in relation to the effectiveness thereof PURPOSE: This is a chapter amendment that makes changes to provisions of L.2021, c.249 and c.746 to create the statewide electronic absentee ballot application transmittal system and allow voters to request an absentee ballot via such system. It also aligns the effective date with the effective date of the statewide online absentee ballot tracking system. SUMMARY OF PROVISIONS:

MYRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend chapter 249 of the laws of 2021, amending the election law relating to electronic applications for absentee ballots, in relation to the effectiveness thereof; and to amend a chapter of the laws of 2021, amending the election law relating to establishing an electronic absentee ballot application transmittal system, as proposed in legislative bills numbers S. 6482-B and A. 6970-A, in relation to the effectiveness thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding the provisions of article 5 of the general construction law, the provisions of paragraph (d) of subdivision 2 of section 8-400 of the election law are hereby revived and shall continue in full force and effect as such provisions existed on December 30, 2021. § 2. Section 2 of chapter 249 of the laws of 2021, amending the election law relating to electronic applications for absentee ballots, is amended to read as follows: § 2. This act shall take effect immediately and shall expire and be deemed repealed on [December 31, 2021] APRIL 1, 2022. § 3. Section 3 of a chapter of the laws of 2021, amending the election law relating to establishing an electronic absentee ballot application transmittal system, as proposed in legislative bills numbers S. 6482-B and A. 6970-A, is amended to read as follows: § 3. This act shall take effect [January] APRIL 1, 2022. Effective immediately, the state board of elections shall be authorized to promul- gate any rules or regulations required to carry out the provisions of this act prior to such effective date. § 4.
