BILL NUMBER: S7863 SPONSOR: CLEARE TITLE OF BILL: An act to amend the general business law, in relation to the sale of space heaters PURPOSE OR GENERAL IDEA OF BILL: To ensure that space heaters sold in New York State conform to the high- est possible fire safety standards. SUMMARY OF SPECIFIC PROVISIONS: The GBL is amended to provide that no space heaters may be sold in New York State unless they: contain a thermostat; have an automatic shut- off; and have been certified by an approved body. CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to the sale of space heaters THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 391-jj to read as follows: § 391-JJ. SALE OF SPACE HEATERS. NO PERSON, FIRM, PARTNERSHIP, ASSOCI- ATION OR CORPORATION SHALL DISTRIBUTE, SELL OR OFFER FOR SALE IN THIS STATE, OR TO ANY PERSON LOCATED IN THIS STATE, A SPACE HEATER UNLESS SUCH SPACE HEATER: 1. INCLUDES A THERMOSTAT; 2. INCLUDES AN AUTOMATIC SHUT-OFF; AND 3. HAS BEEN CERTIFIED BY A TESTING AND CERTIFICATION BODY RECOGNIZED AND APPROVED BY THE UNITED STATES DEPARTMENT OF LABOR, OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION. § 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14319-02-2

SUMMARY OF PROVISIONS: The GBL is amended to provide that no electric space heaters may be sold in New York State by a person, firm, partnership association or corpo- ration regularly engaged in the business of assembling, manufacturing, distributing, or retail sale of space heaters unless they: contain a thermostat; have an automatic shutoff; and have been certified by an approved body.
