 Introduced  by  Sen.  CLEARE -- read twice and ordered printed, and when
   printed to be committed to the Committee on Consumer Protection
 
 AN ACT to amend the general business law, in relation  to  the  sale  of
   space heaters
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The general business law is amended by adding a new section
 391-jj to read as follows:
   § 391-JJ. SALE OF SPACE HEATERS. NO PERSON, FIRM, PARTNERSHIP, ASSOCI-
 ATION OR CORPORATION SHALL DISTRIBUTE, SELL OR OFFER FOR  SALE  IN  THIS
 STATE,  OR  TO  ANY  PERSON LOCATED IN THIS STATE, A SPACE HEATER UNLESS
 SUCH SPACE HEATER:
   1. INCLUDES A THERMOSTAT;
   2. INCLUDES AN AUTOMATIC SHUT-OFF; AND
   3. HAS BEEN CERTIFIED BY A TESTING AND CERTIFICATION  BODY  RECOGNIZED
 AND  APPROVED  BY  THE  UNITED  STATES DEPARTMENT OF LABOR, OCCUPATIONAL
 SAFETY AND HEALTH ADMINISTRATION.
   § 2. This act shall take effect on the ninetieth day  after  it  shall
 have become a law.

 SHIP, ASSOCIATION OR CORPORATION REGULARLY ENGAGED IN  THE  BUSINESS  OF
 ASSEMBLING,  MANUFACTURING,  DISTRIBUTING OR THE RETAIL SALE OF ELECTRIC
 SPACE HEATERS SHALL ASSEMBLE, MANUFACTURE, DISTRIBUTE, SELL OR OFFER  TO
 SELL  ANY ELECTRIC SPACE HEATER IN THE NORMAL COURSE OF BUSINESS IN THIS
 STATE UNLESS SUCH ELECTRIC SPACE HEATER:
   1. INCLUDES A THERMOSTAT;
   2. INCLUDES AN AUTOMATIC SHUT-OFF; AND
   3. HAS BEEN CERTIFIED BY A TESTING AND CERTIFICATION  BODY  RECOGNIZED
 AND  APPROVED  BY  THE  UNITED  STATES DEPARTMENT OF LABOR, OCCUPATIONAL
 SAFETY AND HEALTH ADMINISTRATION.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law.
