HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Alcoholism and Substance Abuse AN ACT to amend the mental hygiene law, in relation to reimbursement for peer and transportation services for individuals with a substance use disorder THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The mental hygiene law is amended by adding a new section 19.18-d to read as follows: § 19.18-D REIMBURSEMENT FOR PEER AND TRANSPORTATION SERVICES. THE OFFICE SHALL ESTABLISH REIMBURSEMENT RATES FOR PEER SERVICES AND TRANSPORTATION SERVICES PROVIDED IN SETTINGS, THAT ARE NOT CERTIFIED BY THE OFFICE, FOR INDIVIDUALS WITH A SUBSTANCE USE DISORDER DIAGNOSIS. AS PART OF THE DEVELOPMENT OF SUCH RATES, THE OFFICE, IN CONSULTATION WITH THE DEPARTMENT OF HEALTH, SHALL PURSUE FEDERAL MEDICAID PARTICIPATION. THE OFFICE SHALL ALSO CONSIDER THE USE OF ANY FEDERAL GRANTS, INCLUDING STATE OPIOID RESPONSE GRANTS AND SUPPLEMENTAL SUBSTANCE ABUSE PREVENTION AND TREATMENT BLOCK GRANTS AND OPIOID LITIGATION SETTLEMENT FUNDS TO SUPPORT SUCH REIMBURSEMENT. SUCH REIMBURSEMENT RATES SHALL BE ESTAB- LISHED BY JANUARY FIRST, TWO THOUSAND TWENTY-THREE. § 2. This act shall take effect immediately.
