TITLE OF BILL:

An act to amend the mental hygiene law, in relation to expanding the
scope of the CHAMP program to include representation for other agencies
whose populations are impacted

 
PURPOSE:

Expands the scope of the CHAMP program to include representation for
other agencies whose populations face additional barriers to care.

 
SUMMARY OF PROVISIONS:

Section 1 amends the mental hygiene law to provide that the CHAMP
program includes representatives from various agencies whose populations
are impacted by substance use disorder and/or mental illness. These
agencies shall include but are not limited to the division of veterans'
services, the office for people with developmental disabilities, the
office of children and family services, the department of corrections,

or providers contracted by such agencies to provide assistance to the
impacted population.

Section 3: States the effective date.

 
JUSTIFICATION:

In 2018 the Community Health Access to Addiction and Mental Health
Project (CHAMP) created an ombudsman program helping individuals access
treatment and insurance coverage for the services they require. This
program has been incredibly successful in helping individuals navigate
this complicated system. The CHAMP program can help investigate and
resolve complaints and violations of rights. It represents individuals
and helps advocate for access to treatment, denial of services, access
to medication, parity/coverage, discrimination issues, system naviga-
tion, medical benefits, enrollment referral, legal assistance for insur-
ance appeals.

This bill seeks to include representatives from various agencies includ-
ing but not limited to the division of veterans' services, the office
for people with developmental disabilities, the office of children and
family services, and the department of corrections to the existing
program.

Individuals who primarily interact with these agencies frequently face
additional challenges in accessing the mental health and substance use
services they need. Expansion of agency representation in the CHAMP
program will help more individuals overcome additional barriers they
face as a result of their unique needs.

 AN  ACT  to  amend  the mental hygiene law, in relation to expanding the
   scope of the CHAMP program to include representation for  other  agen-

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision (a) of section 33.27 of the mental hygiene law,
 as added by section 1 of part FF of chapter 57 of the laws of  2018,  is
 amended to read as follows:
   (a)  There  is  hereby  established  the  office  of  the  independent
 substance use disorder and mental health ombudsman program that will  be
 operated  or  selected by the office of [alcoholism and substance abuse]
 ADDICTION services AND SUPPORTS, in  consultation  with  the  office  of
 mental  health for the purpose of assisting individuals with a substance
 use disorder and/or mental illness to ensure that they receive appropri-
 ate health insurance coverage.  SUCH  PROGRAM  SHALL  INCLUDE  REPRESEN-
 TATIVES   FROM  VARIOUS  AGENCIES  WHOSE  POPULATIONS  ARE  IMPACTED  BY
 SUBSTANCE USE DISORDER AND/OR MENTAL ILLNESS, INCLUDING BUT NOT  LIMITED
 TO THE DIVISION OF VETERANS' SERVICES, THE OFFICE FOR PEOPLE WITH DEVEL-
 OPMENTAL  DISABILITIES,  THE OFFICE OF CHILDREN AND FAMILY SERVICES, THE
 DEPARTMENT OF CORRECTIONS, OR PROVIDERS CONTRACTED BY SUCH  AGENCIES  TO
 PROVIDE ASSISTANCE TO THE IMPACTED POPULATIONS.
