BILL NUMBER: S8474 SPONSOR: SANDERS TITLE OF BILL: An act to amend the environmental conservation law, in relation to the definition of coal tar and its use in pavement products PURPOSE: This bill would reduce the polycyclic aromatic hydrocarbon (PAH) limit in New York State's coal tar ban. SUMMARY OF SPECIFIC PROVISIONS: Section one amends paragraph a of subdivision 3 of section 37-0119 of the environmental conservation law. Section two establishes the effective date. JUSTIFICATION:

SANDERS -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the definition of coal tar and its use in pavement products THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph a of subdivision 3 of section 37-0119 of the environmental conservation law, as added by chapter 596 of the laws of 2021, is amended to read as follows: a. "Coal tar" means a viscous substance obtained by the destructive distillation of coal, INCLUDING BUT NOT LIMITED TO ETHYLENE CRACKED RESIDUES OR STEAM CRACKED RESIDUES, and containing levels of polycyclic aromatic hydrocarbons (PAHs) in excess of [ten] ONE thousand milligrams per kilogram. § 2.
