BILL NUMBER: S8827 SPONSOR: RIVERA TITLE OF BILL: An act in relation to the definition of safety-net providers PURPOSE OR GENERAL IDEA OF BILL: To expand the definition of safety net providers to encompass more hospitals as it relates to New York state fiscal year 2022-2023 Aid to Localities Budget bill, S8003D and A9003D. SUMMARY OF PROVISIONS: Section 1 provides that the term safety net providers, as proposed in fiscal year 2022-2023 Aid to Localities bills S.8003D and A.9003D, shall include a general hospital that: has 2 months or less worth of reserves to cover anticipated expenses, is an enhanced safety net hospital, is at risk of defaulting on existing debt obligations, or needs to undergo a major capital improvement for which the hospital is not able to obtain financing for, and does not have the reserves to cover the costs of such

RIVERA -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT in relation to the definition of safety-net providers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of law to contrary, the term "safety-net providers" as such term is used by a chapter of the laws of 2022 making appropriations for the support of government, as proposed in legislative bills numbers S.8003-D and A.9003-D, shall also include a general hospital as defined by section 2801 of the public health law that: (a) has two months, or less, worth of reserves to cover antic- ipated expenses; (b) is an enhanced safety net hospital as defined by section 2807-c of the public health law; (c) is at risk of defaulting on existing debt obligations; or (d) needs to undergo a major capital improvement in order to maintain existing services that the general hospital cannot obtain financing for and does not have reserves to cover the cost of such capital improvement. § 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2022 making appropriations for the support of government, as proposed in legislative bills numbers S.8003-D and A.9003-D, takes effect.
