BILL NUMBER: S8971 SPONSOR: JORDAN TITLE OF BILL: An act to amend the public officers law, in relation to providing for a waiver of the residency requirement for the city attorney in the city of Saratoga Springs, Saratoga county PURPOSE: This bill permits the City of Saratoga Springs to allow through resol- ution their city attorney to reside outside the City of Saratoga Springs in Saratoga County. SUMMARY OF PROVISIONS: Section 1 amends section 3 of the public officers law by adding new subdivision 72 to authorize the City of Saratoga Springs to appoint any duly licensed, qualified attorney as City Attorney provided such person lives within Saratoga County or an adjoining county within the State of New York.

JORDAN -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public officers law, in relation to providing for a waiver of the residency requirement for the city attorney in the city of Saratoga Springs, Saratoga county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3 of the public officers law is amended by adding a new subdivision 72 to read as follows: 72. IN THE CITY OF SARATOGA SPRINGS, IN THE COUNTY OF SARATOGA, THE PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDIVISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH SUCH PERSON SHALL BE CHOSEN OR WITHIN WHICH THE PERSON'S OFFICIAL FUNC- TIONS ARE REQUIRED TO BE EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING THE OFFICE OF CITY ATTORNEY OF THE CITY OF SARATOGA SPRINGS, PROVIDED THAT SUCH PERSON RESIDES IN SARATOGA COUNTY OR AN ADJOINING COUNTY WITHIN THE STATE OF NEW YORK; PROVIDED, HOWEVER THAT ANY PERSON PERFORMING SUCH FUNCTIONS OR HOLDING SUCH OFFICE OF THE CITY ATTORNEY IN ANY OTHER CITY SHALL BE A RESIDENT OF SUCH CITY UNLESS OTHERWISE PROVIDED BY LAW. § 2.
