BILL NUMBER: S9371 SPONSOR: RYAN TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to allow for an establishment on Hertel Avenue in the city of Buffalo, Revolution Gallery, to be able to obtain a retail license for on-premises consumption even though they are located within two hundred feet of a building occupied as a school or place of worship. SUMMARY OF PROVISIONS: Section 1: amends Subdivision 7 of section 64 of the alcoholic beverage control law, as added a new paragraph e-14, to authorize the, State Liquor Authority to issue a retail license for on-premises consumption for a premises which shall be located within two hundred feet of a

RYAN -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Devel- opment and Small Business AN ACT to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-14) to read as follows: (E-14) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF THIS SUBDI- VISION, THE AUTHORITY MAY ISSUE A RETAIL LICENSE FOR ON-PREMISES CONSUMPTION FOR A PREMISES WHICH SHALL BE LOCATED WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED AS A SCHOOL, CHURCH, SYNAGOGUE OR OTHER PLACE OF WORSHIP, PROVIDED SUCH PREMISES CONSTITUTE A PREMISES FOR THE SALE OF FOOD OR BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE COUNTY OF ERIE, BOUNDED AND DESCRIBED AS FOLLOWS: ALL THAT TRACT OR PARCEL OF LAND SITUATE IN THE CITY OF BUFFALO, COUN- TY OF ERIE AND STATE OF NEW YORK, BEING PART OF LOT NUMBER 76, TOWNSHIP 11, RANGE 8 OF THE HOLLAND LAND COMPANY'S SURVEY AND ACCORDING TO A MAP FILED UNDER COVER NUMBER 613 IS KNOWN AS PART OF SUBDIVISION LOTS NUMBERS 56 AND 57 IN BLOCK "C" AND MORE FULLY DESCRIBED AS FOLLOWS: BEGINNING AT A POINT OF INTERSECTION OF THE SOUTHERLY LINE OF HERTEL AVENUE WITH THE EASTERLY LINE OF NORTH PARK AVENUE; RUNNING THENCE EAST- ERLY ALONG THE SOUTHERLY LINE OF HERTEL AVENUE ONE HUNDRED FIVE (105) FEET; THENCE SOUTHERLY AND PARALLEL WITH NORTH PARK AVENUE ONE HUNDRED FIFTEEN (115) FEET; THENCE WESTERLY AND PARALLEL WITH HERTEL AVENUE ONE HUNDRED FIVE (105) FEET TO THE SAID EASTERLY LINE OF NORTH PARK AVENUE AND THENCE NORTHERLY ALONG SAID EASTERLY LINE OF NORTH PARK AVENUE ONE HUNDRED FIFTEEN (115) FEET TO THE SAID SOUTHERLY LINE OF HERTEL AVENUE, THE POINT OR PLACE OF BEGINNING. § 2.
