Lavine) -- (at request of the Office of Court Administration) -- read once and referred to the Committee on Governmental Employees AN ACT to amend chapter 1 of the laws of 2023 relating to terms and conditions of employment of certain nonjudicial officers and employees of the unified court system and amending chapter 400 of the laws of 2014 relating to terms and conditions of employment of certain nonju- dicial officers and employees of the unified court system, relating to annual longevity payments for certain employees, in relation to the annual maintenance allowance received by employees who are required to wear an employer-approved blazer THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Chapter 1 of the laws of 2023 relating to terms and condi- tions of employment of certain nonjudicial officers and employees of the unified court system and amending chapter 400 of the laws of 2014 relat- ing to terms and conditions of employment of certain nonjudicial offi- cers and employees of the unified court system, relating to annual longevity payments for certain employees, is amended by adding a new section 8-b to read as follows: § 8-B. WHERE A NONJUDICIAL OFFICER OR EMPLOYEE OF THE UNIFIED COURT SYSTEM TO WHOM THE PROVISIONS OF SECTION THREE OR FOUR OF THIS ACT APPLY IS REQUIRED TO WEAR AN EMPLOYER-APPROVED BLAZER WHILE PERFORMING THE DUTIES OF HIS OR HER POSITION AND, ON ACCOUNT THEREOF, IS ENTITLED TO RECEIVE AN ANNUAL MAINTENANCE ALLOWANCE PURSUANT TO A COLLECTIVE BARGAINING AGREEMENT BETWEEN THE UNIFIED COURT SYSTEM AND AN EMPLOYEE ORGANIZATION REPRESENTING SUCH NONJUDICIAL OFFICER OR EMPLOYEE, SUCH ALLOWANCE SHALL NOT BE A PART OF SUCH EMPLOYEE'S BASIC ANNUAL SALARY BUT SHALL BE INCLUDED AS COMPENSATION FOR RETIREMENT PURPOSES. § 2. This act shall take effect immediately and shall be deemed to have been in full force and effect on and after April 1, 2021.
