 AN ACT to amend the public health law, in relation to requiring  nursing
   homes  and  certain  facilities  to provide health care proxy forms to
   patients at or prior to admission to such facilities

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 3 of section 2803-c of the public health law is
 amended by adding a new paragraph s to read as follows:
   S.  EVERY  PATIENT SHALL HAVE THE RIGHT TO CHOOSE A HEALTH CARE PROXY.
 EACH PATIENT SHALL BE PROVIDED WITH A HEALTH CARE PROXY FORM  AND  SHALL
 BE PROVIDED THE OPPORTUNITY TO FILE SUCH FORM WITH THE DEPARTMENT.
   §  2.  Section  2803-c of the public health law is amended by adding a
 new subdivision 7 to read as follows:
   7. EACH FACILITY SHALL PROVIDE  A  HEALTH  CARE  PROXY  FORM  TO  EACH
 PATIENT  AT  OR  PRIOR TO THE TIME OF ADMISSION TO THE FACILITY.  IF THE
 PATIENT DOES NOT ALREADY HAVE A HEALTH CARE PROXY  REGISTERED  WITH  THE
 DEPARTMENT,  THE  FACILITY  SHALL  FILE  SUCH HEALTH CARE PROXY WITH THE
 DEPARTMENT ON BEHALF OF THE PATIENT.
   § 3. This act shall take effect immediately.
