 AN ACT to amend the general business law, in relation to the manufactur-
   ing of portable electronic devices
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The general business law is amended by adding a new article
 40-A to read as follows:
                               ARTICLE 40-A
                        PORTABLE ELECTRONIC DEVICES
 SECTION 925. MANUFACTURING REQUIREMENTS.
   §  925.  MANUFACTURING  REQUIREMENTS.  1.  FOR  THE  PURPOSES  OF THIS
 SECTION, "PORTABLE ELECTRONIC DEVICE" SHALL MEAN  ANY  HAND-HELD  MOBILE
 TELEPHONE, AS DEFINED BY SUBDIVISION ONE OF SECTION TWELVE HUNDRED TWEN-
 TY-FIVE-C  OF  THE  VEHICLE  AND TRAFFIC LAW, PERSONAL DIGITAL ASSISTANT
 (PDA), OR HANDHELD DEVICE WITH MOBILE DATA ACCESS.
   2. ON AND AFTER JANUARY FIRST, TWO THOUSAND TWENTY-FIVE,  NO  MANUFAC-
 TURER  SHALL  PROVIDE  FOR  SALE  IN  THIS STATE ANY PORTABLE ELECTRONIC
 DEVICE NOT EQUIPPED WITH AN ATSC 3.0 CHIP.
   § 2. This act shall take effect immediately.
