 AN ACT to amend the vehicle and traffic law, in relation to  authorizing
   certain  vehicle  registration  refunds  to  be refunded on a prorated
   monthly basis
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision 1-a of section 428 of the vehicle and traffic
 law, as added by section 76-a of part A of chapter 56  of  the  laws  of
 1998, is amended to read as follows:
   1-a.  Notwithstanding  the  provisions  of  subdivision  one  of  this
 section, if a registration is issued for a period of not less  than  two
 years  pursuant  to  paragraph  c  of  subdivision  five of section four
 hundred one of this [chapter] TITLE, the registration fee paid  for  the
 period  commencing after the first twelve month period of such registra-
 tion shall be refunded less the sum of one dollar [provided  the  number
 plates  are  surrendered to the commissioner before the end of the first
 twelve month period of such registration  and  application  therefor  is
 filed with the commissioner within two months from the expiration of the
 first  twelve  month  period  of  such  registration] IN AN AMOUNT TO BE
 PRORATED ON A MONTHLY BASIS. SUCH PRORATED AMOUNT SHALL BE DETERMINED ON
 THE FIRST OF THE MONTH AND SHALL CONTINUE AT SUCH RATE UNTIL  THE  FIRST
 OF THE FOLLOWING MONTH.
   § 2. This act shall take effect immediately.
