Provides for apportionment for charter school tuition payments for any school district that is required to pay tuition to charter schools in the two thousand twenty-three-two thousand twenty-four school year and thereafter.

 AN ACT to amend the education law,  in  relation  to  apportionment  for
   charter school tuition payments
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 3602 of the education law is amended  by  adding  a
 new subdivision 42 to read as follows:
   42.  AID FOR CHARTER TUITION PAYMENTS. (A) ANY SCHOOL DISTRICT THAT IS
 REQUIRED TO PAY TUITION TO CHARTER SCHOOLS PURSUANT TO  SECTION  TWENTY-
 EIGHT  HUNDRED  FIFTY-SIX  OF  THIS  CHAPTER IN THE TWO THOUSAND TWENTY-
 THREE--TWO THOUSAND TWENTY-FOUR SCHOOL  YEAR  AND  THEREAFTER  SHALL  BE
 ELIGIBLE FOR AN APPORTIONMENT UNDER THIS SUBDIVISION.
   (B)  EACH  SCHOOL YEAR, ANY SUCH ELIGIBLE SCHOOL DISTRICT SHALL SUBMIT
 THE TOTAL AMOUNT OF CHARTER SCHOOL TUITION PAID BY THE DISTRICT  IN  THE
 BASE YEAR ON A FORM PRESCRIBED BY THE COMMISSIONER.
   (C)  THE  APPORTIONMENT  FOR  CHARTER  SCHOOL PAYMENTS SHALL EQUAL THE
 POSITIVE DIFFERENCE, IF ANY, OF THE AMOUNT OF TUITION PAID IN  THE  BASE
 YEAR  LESS THE AMOUNT OF TUITION PAID IN THE TWO THOUSAND TWENTY-THREE--
 TWO THOUSAND TWENTY-FOUR SCHOOL YEAR.
   § 2. This act shall take effect immediately.
