S T A T E O F N E W Y O R K ________________________________________________________________________ 6060 2023-2024 Regular Sessions I N A S S E M B L Y March 31, 2023 ___________ Introduced by M. of A. K. BROWN -- read once and referred to the Commit- tee on Governmental Operations AN ACT to amend the executive law, in relation to requiring certain entities when relying on statistics in planning, policy enforcement and reporting be based on the worst-case scenario THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 170-g to read as follows: § 170-G. WORST-CASE SCENARIO PLANNING, POLICY ENFORCEMENT AND REPORT- ING. EVERY DEPARTMENT, BUREAU, BOARD, COMMISSION, AUTHORITY, OR ANY OTHER AGENCY OR INSTRUMENTALITY OF THE STATE SHALL, WHEN RELYING ON STATISTICS IN PLANNING, POLICY ENFORCEMENT AND REPORTING, BASE SUCH PLANNING, POLICY ENFORCEMENT AND REPORTING ON THE WORST-CASE SCENARIO. FOR THE PURPOSE OF THIS SECTION, THE TERM "BASE SUCH PLANNING, POLICY ENFORCEMENT AND REPORTING ON THE WORST-CASE SCENARIO" SHALL MEAN: 1. PLANS ARE CREATED WITH THE HIGHEST DEGREE OF SAFETY SUCH THAT ANY PLAN WILL REMAIN VIABLE IF THE WORST-CASE SCENARIO OCCURS. 2. POLICIES ARE ENFORCED TO REDUCE THE LIKELIHOOD OF A WORST-CASE SCENARIO WHILE ASSUMING THAT THE WORST-CASE SCENARIO IS OCCURRING. 3. REPORTS SHOW THE WORST-CASE SCENARIO STATISTICS AND FINDINGS IF THE STATISTICS AND FINDINGS ARE NOT ABSOLUTE. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such effective date.
