 AN  ACT  to  amend the public health law, in relation to requiring third
   trimester syphilis testing
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Subdivision 1 of section 2308 of the public health law is
 amended to read as follows:
   1. Every physician OR OTHER AUTHORIZED PRACTITIONER attending pregnant
 [women] PATIENTS in the state shall in the case of every [woman] PATIENT
 so attended take or cause to be taken a sample of blood of such  [woman]
 PATIENT  at  the time of first examination, and submit such sample to an
 approved laboratory for a standard serological  test  for  syphilis.  IN
 ADDITION  TO TESTING AT THE TIME OF FIRST EXAMINATION, EVERY SUCH PHYSI-
 CIAN OR OTHER AUTHORIZED PRACTITIONER SHALL ORDER A SYPHILIS TEST DURING
 THE THIRD TRIMESTER OF PREGNANCY CONSISTENT WITH ANY GUIDANCE AND  REGU-
 LATIONS ISSUED BY THE COMMISSIONER.
   §  2. This act shall take effect one year after it shall have become a
 law. Effective immediately, any rules and regulations or guidance neces-
 sary to implement the provisions of this act on its effective  date  are
 authorized  to be amended, repealed and/or promulgated on or before such
 date.
