   SIMPSON,  SLATER, SMITH, SMULLEN, TAGUE, TANNOUSIS, WALSH -- read once
   and referred to the Committee on Energy
 
 AN ACT to amend the energy law, in relation to  prohibiting  the  elimi-
   nation  of  building  systems  or equipment used for the combustion of
   fossil fuels in new building construction
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 11-104 of the energy law is amended by adding a new
 subdivision 7 to read as follows:
   7.  NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (B) OF SUBDIVISION ONE
 OF SECTION 11-103 OF THIS ARTICLE, THE CODE SHALL NOT PROHIBIT  BUILDING
 SYSTEMS  OR EQUIPMENT USED FOR THE COMBUSTION OF FOSSIL FUELS INCLUDING,
 BUT NOT LIMITED TO, NATURAL GAS, PROPANE,  AND  FUEL  OIL,  IN  ANY  NEW
 BUILDING CONSTRUCTION STATEWIDE, NOR SHALL SUCH SYSTEMS BE PROHIBITED IN
 ANY  EXISTING BUILDING CONSTRUCTION STATEWIDE, INCLUDING RENOVATIONS AND
 REPLACEMENT OF EXISTING SYSTEMS.
   § 2. This act shall take effect immediately.
