 AN ACT to amend the Nassau county civil divisions act,  in  relation  to
   the Volunteer and Exempt Firemen's Benevolent Association of Williston
   Park
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision a of section 610.0 of the Nassau  county  civil
 divisions act, as added by chapter 73 of the laws of 1940, is amended to
 read as follows:
   a.  The  corporation  by the name of "Volunteer and Exempt [Firemen's]
 FIREFIGHTER'S Benevolent  Association  of  Williston  Park,"  is  hereby
 continued.
   §  2. Section 610.4 of the Nassau county civil divisions act, as added
 by chapter 73 of the laws of 1940, is amended to read as follows:
   § Section 610.4 Control  and  disposal  of  funds  and  property.  The
 control  and  disposal  of the funds, property and estate of such corpo-
 ration and the management of its affairs shall be vested in a  board  of
 trustees,  which  shall  consist  of  [twelve]  EIGHTEEN members of such
 corporation, to wit: six members to be elected from  either  the  active
 membership or exempt membership of company number one, SIX MEMBERS TO BE
 ELECTED FROM EITHER THE ACTIVE MEMBERSHIP OR EXEMPT MEMBERSHIP OF COMPA-
 NY  NUMBER  TWO,  and  six  members TO BE ELECTED from EITHER the active
 membership or exempt membership of company number  [two]  THREE  of  the
 Williston  Park  fire department. The officers of such corporation shall
 be in such number and designated and shall have and exercise such powers
 and duties as may be provided by the by-laws. The trustees and  officers
 shall be elected at the annual meeting of such corporation in the manner
 prescribed by its by-laws.
   §  3. Section 610.5 of the Nassau county civil divisions act, as added
 by chapter 73 of the laws of 1940, is amended to read as follows:

   § Section 610.5 Precept for payment of foreign fire insurance  premium
 taxes.  a.  Such corporation shall collect and there shall be paid to it
 all tax imposed by section [five]  NINE  THOUSAND  ONE  hundred  [fifty-
 three]  FOUR  of the insurance law, for fire department use and benefit,
 upon  premiums  on  policies of insurance against loss or damage by fire
 covering property situated within the incorporated village of  Williston
 Park  immediately  protected  by the Williston Park fire department, and
 within any duly organized territory in which  the  Williston  Park  fire
 department is, or may hereafter be, obligated to render fire protection.
   b.  The  officer  of  such  corporation  designated  by its by-laws to
 collect and receive the aforesaid tax shall  have  the  same  powers  as
 provided  by  law for the treasurer of a fire department with respect to
 such collection and receipt.
   c. Such corporation shall also be entitled to receive a share  of  the
 tax  imposed  by  section  [five] NINE THOUSAND ONE hundred [fifty-four]
 FIVE of the insurance law, based upon the premiums written in the terri-
 tory with respect to which it is entitled to collect and receive the tax
 under section [five hundred fifty-three] NINE THOUSAND ONE HUNDRED  FOUR
 of the insurance law.
   d.  Such taxes shall only be used [for the care and relief of disabled
 or indigent volunteer and exempt firemen and their families] IN FURTHER-
 ANCE OF ITS PURPOSES SET FORTH IN SECTION 610.1 OF THIS ACT.
   § 4. This act shall take effect immediately.
