 AN ACT to amend the civil service law, in relation  to  authorizing  the
   Syracuse  Hancock  International Airport to hire and promote employees
   on a permanent basis

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Section 65 of the civil service law is amended by adding a
 new subdivision 7 to read as follows:
   7. SYRACUSE REGIONAL AIRPORT AUTHORITY  OPERATED  AIRPORT.    NOTWITH-
 STANDING  ANY  LAW,  RULE  OR  REGULATION  TO THE CONTRARY, THE SYRACUSE
 HANCOCK INTERNATIONAL AIRPORT MAY:  (A) APPOINT OR PROMOTE TO  A  PERMA-
 NENT  POSITION  IN THE EXEMPT CLASS FOR TITLES THAT ARE CRITICAL AIRPORT
 MANAGEMENT AND SUPERVISORY POSITIONS THAT INCLUDE BUT ARE NOT LIMITED TO
 AIRPORT OR  AUTHORITY:  DIRECTOR  AND  ASSISTANT  DIRECTOR;  MANAGER  OR
 ASSISTANT  MANAGER;  AIRCRAFT  RESCUE  AND  FIREFIGHTING CHIEF; AVIATION
 FINANCE DIRECTOR; COMMERCIAL  DEVELOPMENT  OFFICER;  AVIATION  SECURITY,
 OPERATIONS  RESPONSIBLE FOR FAR PART 139 COMPLIANCE; AND CHIEF OPERATING
 OFFICER; WHENEVER THERE IS NO APPROPRIATE ELIGIBLE  LIST  AVAILABLE  FOR
 FILLING  A  VACANCY IN THE SELECTIVE EXEMPT CLASS; (B) IF SUCH APPOINTEE
 SHALL BE DETERMINED BY SUCH AIRPORT OR AUTHORITY AS QUALIFIED;  AND  (C)
 NO  PERSON  SHALL BE APPOINTED, PROMOTED OR EMPLOYED UNDER ANY TITLE NOT
 APPROPRIATE TO THE DUTIES TO BE PERFORMED AND, EXCEPT UPON ASSIGNMENT BY
 PROPER AUTHORITY DURING THE CONTINUANCE OF A TEMPORARY  EMERGENCY  SITU-
 ATION, NO PERSON SHALL BE ASSIGNED TO PERFORM THE DUTIES OF ANY POSITION
 UNLESS HE OR SHE HAS BEEN DULY APPOINTED, PROMOTED, TRANSFERRED OR REIN-
 STATED TO SUCH POSITION IN ACCORDANCE WITH THE PROVISIONS OF THIS SUBDI-
 VISION AND THE RULES PRESCRIBED THEREUNDER.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law.
