 AN ACT to amend the retirement and social security law, in  relation  to
   eligibility for certain New York city transit authority members chang-
   ing to transit operating positions from other positions to participate
   in the twenty-five-year and age fifty-five retirement program
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision e of section 604-b of the retirement and social
 security law is amended by adding a new paragraph 12 to read as follows:
   12. NOTWITHSTANDING ANY OTHER  PROVISION  OF  LAW  INCLUDING,  WITHOUT
 LIMITATION, THIS SECTION OR SECTION 13-161 OF THE ADMINISTRATIVE CODE OF
 THE  CITY  OF  NEW YORK NOR ANY PRIOR RESOLUTION ADOPTED BY THE NEW YORK
 CITY TRANSIT AUTHORITY IN ACCORDANCE WITH SUCH SECTION OF  THE  ADMINIS-
 TRATIVE  CODE OF THE CITY OF NEW YORK, ANY TRANSIT ANNUALLY-PAID EMPLOY-
 EE, ANY TRANSIT ANNUALLY-PAID NON-OPERATING EMPLOYEE WITH PRIOR  TRANSIT
 SERVICE AND ANY SUBSEQUENTLY APPOINTED TRANSIT ANNUALLY-PAID NON-OPERAT-
 ING  EMPLOYEE, AS SUCH TERMS ARE DEFINED BY SECTION 13-161 OF THE ADMIN-
 ISTRATIVE CODE OF THE CITY OF NEW  YORK,  SHALL,  UPON  TRANSFER,  HIRE,
 PROMOTION  OR  OTHER  EMPLOYMENT  AS  A  TRANSIT ANNUALLY-PAID OPERATING
 EMPLOYEE, AS SUCH TERM IS DEFINED BY SECTION 13-161 OF  THE  ADMINISTRA-
 TIVE CODE OF THE CITY OF NEW YORK, BE ELIGIBLE TO ELECT PARTICIPATION IN
 THE RETIREMENT PROGRAM SET FORTH IN THIS SECTION.
   § 2. This act shall take effect immediately.
