 AN ACT to amend the penal law, in relation to establishing  the  ammuni-
   tion purchase certification act
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. This act shall be known as the "ammunition purchase certif-
 ication act".
   § 2. The penal law is amended by adding a new section 400.04  to  read
 as follows:
 § 400.04 AMMUNITION PURCHASE PERMIT NUMBER.
   1.  NO  PERSON SHALL PURCHASE AMMUNITION IN THIS STATE WITHOUT A VALID
 AMMUNITION PURCHASE PERMIT  NUMBER  ISSUED  BY  THE  DIVISION  OF  STATE
 POLICE.    THE  DIVISION  OF  STATE  POLICE  SHALL SERVE AS THE POINT OF
 CONTACT FOR THE PROCESSING OF AMMUNITION PURCHASING  PERMITS  AND  SHALL
 ESTABLISH CRITERIA AND PROCEDURES FOR THE ISSUANCE, RENEWAL, SUSPENSION,
 AND REVOCATION OF SUCH PERMITS.
   2.  AN  AMMUNITION  PURCHASE  PERMIT  SHALL BE ISSUED SUBSEQUENT TO AN
 INDIVIDUAL PASSING THE REQUIRED BACKGROUND CHECK  FOR  THE  PURCHASE  OF
 AMMUNITION OR AFTER APPROVAL VIA APPLICATION, AS DETERMINED BY THE DIVI-
 SION  OF  STATE POLICE, AND SHALL BE VALID FOR A PERIOD OF ONE YEAR FROM
 SUCH INITIAL PURCHASE OR DATE OF ISSUE. THERE SHALL BE NO ADDITIONAL FEE
 FOR SUCH ISSUANCE. THE CURRENT FEE OF TWO DOLLARS AND FIFTY CENTS  SHALL
 BE CHARGED AT THE TIME OF THE INITIAL PURCHASE OR FILING OF THE APPLICA-
 TION AND ANY SUBSEQUENT RENEWAL.
   3. EACH PERMIT SHALL BE A PHYSICAL PERMIT CARD WITH A UNIQUE IDENTIFI-
 CATION  NUMBER.  FROM  THE DATE OF ISSUANCE, PURCHASERS SHALL USE EITHER
 THE PERMIT CARD OR ITS  UNIQUE  IDENTIFICATION  NUMBER  WHEN  PURCHASING
 AMMUNITION.
   4.  THE  PERMIT  NUMBER  MAY BE RENEWED FOR A SUBSEQUENT PERIOD OF ONE
 YEAR UPON A VALID PURCHASE AFTER THE EXPIRATION OF SUCH PERMIT NUMBER.
