AN ACT to amend the vehicle and traffic law, in relation to including in
facilitating aggravated unlicensed operation of a motor vehicle
consenting to the operation of a motor vehicle by a person who is less
than eighteen years of age who has never had a license
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 1 of section 511-a of the vehicle and traffic
law, as amended by chapter 606 of the laws of 1993, is amended to read
as follows:
1. A person is guilty of the offense of facilitating aggravated unli-
censed operation of a motor vehicle in the third degree when such person
consents to the operation upon a public highway of a motor vehicle
registered in such person's name knowing or having reason to know that
the operator of such vehicle:
(A) is a person whose license or privilege of operating such motor
vehicle in this state or privilege of obtaining a license issued to
operate such motor vehicle by the commissioner is suspended, revoked or
otherwise withdrawn by the commissioner and the vehicle is operated upon
a public highway by such person; OR
(B) IS A PERSON WHO IS LESS THAN EIGHTEEN YEARS OF AGE WHO HAS NEVER
HAD A LICENSE OR THE PRIVILEGE OF OPERATING SUCH MOTOR VEHICLE IN THIS
STATE AND THE VEHICLE IS OPERATED UPON A PUBLIC HIGHWAY BY SUCH PERSON
RESULTING IN PHYSICAL INJURY TO ANOTHER PERSON.
§ 2. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law. Effective immediately,
the addition, amendment and/or repeal of any rule or regulation neces-
sary for the implementation of this act on its effective date are
authorized to be made and completed on or before such effective date.
