2023-A8419 (ACTIVE) - Summary

Exempts horse-drawn carriages or carts from the ban on night riding if they display at least two lighted lamps on the front of the vehicle, one on each side, having light sources of equal power and visible from the front for a distance of at least three hundred fifty feet; at least one lighted lamp on the rear, located between the center and the left side of the vehicle, which shall display a red or amber fixed or flashing light visible from a distance of at least five hundred feet; and reflective material upon the shafts of the vehicle or other parts thereof which shall normally parallel the body, head or legs of the horse pulling such vehicle.

 AN ACT to amend the vehicle and traffic law, in relation  to  exceptions
   to the ban on night riding
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Section 1264 of the vehicle and traffic law, as amended  by
 chapter 676 of the laws of 1990, is amended to read as follows:
   § 1264. Ban on night riding.  (A) No person shall ride or lead a horse
 upon  a  roadway  during  the  period from one-half hour after sunset to
 one-half  hour  before  sunrise,  PROVIDED  HOWEVER   THAT   HORSE-DRAWN
 CARRIAGES  OR  CARTS  MAY BE DRIVEN UPON A ROADWAY DURING SUCH PERIOD IF
 THEY DISPLAY:
   (1) AT LEAST TWO LIGHTED LAMPS ON THE FRONT OF  THE  VEHICLE,  ONE  ON
 EACH  SIDE,  HAVING  LIGHT  SOURCES  OF EQUAL POWER AND VISIBLE FROM THE
 FRONT FOR A DISTANCE OF AT LEAST THREE HUNDRED FIFTY FEET;
   (2) AT LEAST ONE LIGHTED LAMP ON THE REAR, LOCATED BETWEEN THE  CENTER
 AND  THE  LEFT  SIDE  OF THE VEHICLE, WHICH SHALL DISPLAY A RED OR AMBER
 FIXED OR FLASHING LIGHT VISIBLE FROM A DISTANCE OF AT LEAST FIVE HUNDRED
 FEET; AND
   (3) REFLECTIVE MATERIAL UPON THE SHAFTS OF THE VEHICLE OR OTHER  PARTS
 THEREOF  WHICH  SHALL  NORMALLY  PARALLEL  THE BODY, HEAD OR LEGS OF THE
 HORSE PULLING SUCH VEHICLE.
   (B) The provisions of this section shall  not  apply  to  [horse-drawn
 carriages  or  carts or] police officers, peace officers or park rangers
 mounted on horseback.
   § 2. This act shall take effect on the ninetieth day  after  it  shall
 have become a law.
