 AN ACT to amend the criminal procedure law and  the  education  law,  in
   relation  to granting police officer status to university campus peace
   officers employed by the city university of New York;  and  to  repeal
   certain provisions of the criminal procedure law relating thereto

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 34 of section 1.20 of  the  criminal  procedure
 law is amended by adding a new paragraph (w) to read as follows:
   (W)  A CAMPUS POLICE OFFICER APPOINTED BY THE CITY UNIVERSITY PURSUANT
 TO SUBDIVISION SIXTEEN OF SECTION SIX THOUSAND TWO HUNDRED  SIX  OF  THE
 EDUCATION  LAW,  WHO  SHALL  HAVE THEIR POWERS SET FORTH IN THIS SECTION
 WHETHER OR NOT THEY ARE ACTING PURSUANT TO THEIR OFFICIAL DUTIES.
   § 2. Paragraph (a) of subdivision 34-a of section 1.20 of the criminal
 procedure law, as amended by chapter 428 of the laws of 1999, is amended
 and a new paragraph (f) is added to read as follows:
   (a) Except as provided in [paragraph] PARAGRAPHS (d) AND (F)  of  this
 subdivision,  New  York  state  constitutes  the  "geographical  area of
 employment" of any police officer employed as such by an agency  of  the
 state  or  by  an  authority  which functions throughout the state, or a
 police officer designated by the superintendent of state police pursuant
 to section two hundred twenty-three of the executive law;
   (F) THE GEOGRAPHICAL AREA OF EMPLOYMENT OF A POLICE OFFICER  APPOINTED
 BY  THE  CITY  UNIVERSITY IS THE CAMPUSES AND OTHER PROPERTY OF THE CITY
 UNIVERSITY, INCLUDING ANY PORTION OF A PUBLIC HIGHWAY WHICH  CROSSES  OR
 ABUTS SUCH PROPERTY.
   § 3. Paragraph (a) of subdivision 34-a of section 1.20 of the criminal
 procedure law, as amended by chapter 424 of the laws of 1998, is amended
 to read as follows:
   (a)  Except  as provided in [paragraph] PARAGRAPHS (d) AND (F) OF THIS
 SUBDIVISION, New  York  state  constitutes  the  "geographical  area  of
 employment"  of  any police officer employed as such by an agency of the
 state or by an authority which functions throughout the state;
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.
