 AN  ACT  to  amend  the  public  officers  law,  in relation to the term
   "employee" for the purposes of defense and indemnification of officers
   and employees of public entities
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Paragraph (b) of subdivision 1 of section 18 of the public
 officers law, as added by chapter 277 of the laws of 1981, is amended to
 read as follows:
   (b) The term "employee" shall  mean  any  commissioner,  member  of  a
 public board or commission, trustee, director, officer, employee, volun-
 teer  expressly authorized to participate in a publicly sponsored volun-
 teer program, or any  other  person  holding  a  position  by  election,
 appointment  or employment in the service of a public entity, whether or
 not compensated, but shall not include [the sheriff of any county or an]
 ANY independent contractor. The term "employee" shall include  a  former
 employee,  [his] SUCH EMPLOYEE'S estate or judicially appointed personal
 representative.
   § 2. This act shall take effect immediately.
