S T A T E O F N E W Y O R K ________________________________________________________________________ 9657 I N A S S E M B L Y March 27, 2024 ___________ Introduced by M. of A. BENEDETTO -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to proper registration of abandoned vehicles THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 3 of section 1224 of the vehi- cle and traffic law, as amended by chapter 726 of the laws of 1983, is amended to read as follows: (b) Such local authority shall notify the last owner, if known, that the vehicle in question has been recovered as an abandoned vehicle and that, if unclaimed, it will be sold at public auction or by bid after ten days from the date such notice was given. If the agency described in paragraph (a) OF THIS SUBDIVISION also notifies such local authority that a lien or mortgage exists such notice shall also be sent to the lienholder or mortgagee. The commissioner shall prescribe the methods of giving notice. Any person claiming such vehicle shall be required to pay the costs of removal and storage of such vehicle. IN A CITY HAVING A POPULATION OF ONE MILLION OR MORE, IF AN ABANDONED VEHICLE IS FOUND TO HAVE A FALSE OR FRAUDULENT CERTIFICATE OF REGISTRATION OR NUMBER PLATE, ANY PERSON CLAIMING SUCH VEHICLE SHALL, IN ORDER TO CLAIM SUCH VEHICLE, PROVIDE PROOF TO SUCH LOCAL AUTHORITY THAT SUCH VEHICLE IS NOW LAWFULLY REGISTERED PURSUANT TO SECTION FOUR HUNDRED ONE OF THIS CHAPTER. § 2.
