TITLE OF BILL:

An act in relation to prohibiting a government entity, its political
subdivisions, agents or assigns from issuing regulations or guidance
related to the COVID-19 virus without first getting approval from the
state legislature

 
PURPOSE:

The purpose of this bill is to restore a system of checks and balances
to New York State government. This measure would resume the state legis-
lature's responsibility to serve as a co-equal branch of government by
ensuring that. any COVID-19 related measures taken by the state are
always approved by the legislature.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1. The New York State Legislature may authorize a regulation or
guidance related to COVID-19 virus by concurrent resolution.

Section 2. This act shall take effect immediately.

 
JUSTIFICATION:

At the onset of the COVID-19 pandemic in New York, the state legislature
voted to cede their constitutional responsibility to the Governor by
allowing him to suspend laws and write his own, without approval from
the state legislature. This was, and remains, way too much power for one
individual.

On many occasions, the Governor's unjustified and unscientific
restrictions hurt so many New Yorkers, causing many to leave the state
and others to close their business for good.

In order to ensure mistakes of the past are not repeated, the state
legislature must fulfill its constitutional responsibility to require
legislative approval on any regulations or guidance as it relates to the
COVID-19 virus.

 AN ACT in relation to prohibiting a  government  entity,  its  political
   subdivisions,  agents  or assigns from issuing regulations or guidance
   related to the COVID-19 virus without first getting approval from  the
   state legislature
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.  No  government  entity,  or  its  political  subdivisions,
 agents, or assigns, shall be permitted to issue a regulation or guidance
 that  includes criminal or civil penalties related to the COVID-19 virus
 without prior authorization from the state legislature. The  legislature
 may authorize a regulation or guidance by concurrent resolution.
