TITLE OF BILL:

An act to authorize certain health care professionals licensed to prac-
tice in other jurisdictions to practice in this state in connection with
Double H Ranch; and providing for the repeal of such provisions upon
expiration thereof

 
PURPOSE:

To exempt Double H Ranch in Lake Luzerne from certain state licensing
requirements for medical professionals licensed in other states or
territories when the facility is operational.

 
SUMMARY OF PROVISIONS:

Section 1 - Allows any physician or nurse licensed in another state or
territory, and in good standing with such state or territory, and with a
written agreement with Double H Ranch, to provide medical services to
children and staff.

Section 2 - Provides effective date. This bill will expire one year
after the effective date.

 
JUSTIFICATION:

For decades, Double H Ranch has provided recreational opportunities to
children with serious, often life-threatening, medical conditions.

Each year, about 2,100 children take part in the year-round programs
offered at Double H Ranch, which include a seven-week summer session,
family weekends in the spring and fall seasons, and a winter ski
program.

Children and families regularly travel from across the country for the
programs at Double H Ranch. Often, out-of-state hospitals send groups of
children with a specific illness. But under state law, their medical
providers - experts in a specific illness and familiar with each child's
needs - cannot practice within New York.

The same is true for nurses specializing in the care of these children
with very specific needs.

State law further hampers Double H Ranch because it limits the organiza-
tion's pool of potential volunteers. As such, Double H sometimes pays
for a state nursing license for volunteers. However, paying for physi-
cian licenses is not feasible for this not-for-profit charitable organ-
ization.

Double H Ranch provides life-changing services to children who need it
most. It is only right to bolster the organization's ability to do so,
while ensuring those benefiting from the program receive the best care
possible.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. 1. Notwithstanding any inconsistent provision of  law,  any
 person  who is licensed or certified to practice as a physician or nurse
 in another state or territory, who is in good standing in such state  or
 territory,  and  who has a written agreement to provide medical services
 with Double H Ranch in the  town  of  Lake  Luzerne,  may  provide  such
 professional  services  to  children and staff without being licensed to
 practice pursuant to the provisions of title eight of the education law.
 Such services shall be provided only when Double H Ranch is operational.
   2. Any person practicing as a physician in New York state pursuant  to
 this  act  shall be subject to the personal and subject matter jurisdic-
 tion and disciplinary and regulatory authority of the board  of  regents
 and  the state board for professional medical conduct established pursu-
 ant to section two hundred thirty of the public health law as if  he  or
 she  is  a  licensee  and  as if the exemption pursuant to this act is a
 license. Such individual shall  comply  with  applicable  provisions  of
 title  eight  of  the education law, the public health law, the rules of
 the board of regents, the state board for professional  medical  conduct
 established  pursuant to section two hundred thirty of the public health
 law, and the regulations  of  the  commissioner  of  education  and  the
 commissioner  of  health, relating to professional misconduct, discipli-
 nary proceedings and penalties for professional misconduct.
   § 2. This act shall take effect immediately and shall  expire  and  be
 deemed repealed one year after such date.
