BILL NUMBER: S2349 SPONSOR: MYRIE TITLE OF BILL: An act to amend the election law, in relation to the providing that a voter may register to vote at any residence to which the voter maintains a continuous connection with an intent to return PURPOSE: This bill provides that a voter may register to vote at any residence to which the voter maintains a continuous connection with an intent to return. SUMMARY OF PROVISIONS: Section 1 amends section 5-104 of the election law by adding a new subdivision 3 which allows a voter to vote from any residence to which the voter maintains a continuous connection with an intent to return, including a second or vacation home.

MYRIE, LIU -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to the providing that a voter may register to vote at any residence to which the voter main- tains a continuous connection with an intent to return THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 5-104 of the election law is amended by adding a new subdivision 3 to read as follows: 3. NOTHING IN THIS SECTION SHALL PREVENT A VOTER FROM REGISTERING TO VOTE FROM ANY RESIDENCE TO WHICH THE VOTER MAINTAINS A CONTINUOUS CONNECTION WITH AN INTENT TO RETURN, INCLUDING A SECOND OR VACATION HOME. § 2. The opening paragraph of subdivision 1 of section 8-400 of the election law, as amended by chapter 63 of the laws of 2010, is amended to read as follows: A qualified voter may vote as an absentee voter under this chapter FROM A RESIDENCE AT WHICH THE VOTER IS REGISTERED TO VOTE, INCLUDING ANY RESIDENCE TO WHICH THE VOTER MAINTAINS A CONTINUOUS CONNECTION WITH AN INTENT TO RETURN SUCH AS A SECOND OR VACATION HOME, if, on the occur- rence of any village election conducted by the board of elections, primary election, special election, general election or New York city community school board district or city of Buffalo school district election, he or she expects to be: § 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD01414-02-3
