TITLE OF BILL:

An act to amend chapter 54 of the laws of 2022, enacting the capital
projects budget, in relation to making technical corrections thereto

 
PURPOSE OR GENERAL IDEA OF BILL:

To expand existing capital grants for nonprofits at risk of hate crimes
to small businesses at risk of hate crimes.

 
SUMMARY OF PROVISIONS:

Section 1 adds small businesses at risk of hate crimes as eligible
recipients of the Securing Communities Against Hate Crimes program.

Section 2 establishes the effective date.

 
JUSTIFICATION:

New York State created the Securing Communities Against Hate Crimes
program in 2017 to provide capital grants to institutions that are
vulnerable to hate crimes because of their ideology, beliefs or mission,
but the program is currently limited only to non-profits.  Grant recipi-
ents can receive up to $150,000 each to support security improvements
like lighting, locks, alarms, panic buttons, fencing, barriers, access
controls, shatter-resistant glass and blast resistant film, public
address systems, and cyber security measures.  As of November 2022, the
program has awarded $83.1 million to 600 organizations supporting about
1,700 projects.

Many small businesses are also targets of the hate crimes the program is
meant to prevent, but they are cut out of the existing program.  For
example, LGBTQ bars and nightclubs are meant to be safe spaces, but
they're under attack across the nation.

The recent mass shooting at Club Q in Colorado Springs brings to mind
the massacre of the Pulse nightclub shooting in Orlando, which was the
deadliest anti-LGBT crime in United States history.

New York State can act now by expanding the successful Securing Communi-
ties Against Hate Crimes program to include small businesses at risk of
hate crimes, like LGBTQ bars and nightclubs, so that they can install
life-saving security improvements that could prevent a terrorist attack
or hate crime in our community.

This act shall take effect immediately and shall be deemed to have been

 AN ACT to amend chapter 54 of the laws of  2022,  enacting  the  capital

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 1 of chapter 54 of the laws of 2022,  enacting  the
 capital  projects  budget, is amended by repealing the items hereinbelow
 set forth in brackets and by adding to  such  section  the  other  items
 underscored in this section:

 For competitive grants to provide safety and
   security  projects  at nonprofit organiza-
   tions  OR SMALL  BUSINESS  AS  DEFINED  BY
   SECTION  131  OF  THE ECONOMIC DEVELOPMENT
   LAW  at  risk  of  hate  crimes or attacks
   including, but not limited to, at a facil-
   ity, virtually or on the internet  because
   of  their  ideology,  beliefs  or mission.
   Provided that an assessment of  facilities
   at  risk  may  include, but not be limited
   to, considerations of the  vulnerabilities
   of  the organization based on its location
   and membership, and the  potential  conse-
   quences  of  a hate crime or attack at the
   facility. Recipients of such grants  shall
   be  entitled to use such funds to purchase
   commodities,  services,   and   technology
   through  centralized contracts established
   by the office of  general  services  under
   section  163 of the state finance law, and
   such recipients shall be deemed  for  such
   purpose  to be authorized users within the
   meaning of paragraph k of subdivision 1 of
   section 163 of the state finance law.  All
   or  a  portion  of  the funds appropriated
   herein may be suballocated to any  depart-
   ment or agency (CJSS2208) ................... 25,000,000
   §  2.  This  act  shall take effect immediately and shall be deemed to
 have been in full force and effect on and after April 1, 2022.
