 Introduced  by  Sen.  RAMOS  -- read twice and ordered printed, and when
   printed to be committed to the Committee on Investigations and Govern-
   ment Operations
 
 AN ACT to amend the executive law, in relation to defining employees  of
   the state
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 6 of section  292  of  the  executive  law,  as
 amended  by  chapter  830  of  the  laws  of 2021, is amended to read as
 follows:
   6. The term "employee" in this article does not include any individual
 employed by his or her parents, spouse,  or  child;  PROVIDED,  HOWEVER,
 THAT  FOR  THE  PURPOSES  OF THIS ARTICLE, THE FOLLOWING SHALL BE DEEMED
 EMPLOYEES OF THE STATE:
   (A) STATEWIDE ELECTED OFFICIALS, INCLUDING  THE  GOVERNOR,  LIEUTENANT
 GOVERNOR, COMPTROLLER, AND ATTORNEY GENERAL;
   (B) STATE OFFICERS AND EMPLOYEES, INCLUDING:
   (I)  HEADS  OF STATE DEPARTMENTS AND THEIR DEPUTIES AND ASSISTANTS WHO
 SERVE AT THE DISCRETION OF A STATEWIDE ELECTED OFFICIAL; AND
   (II) OFFICERS AND EMPLOYEES OF STATEWIDE ELECTED OFFICIALS  WHO  SERVE
 AT THE DISCRETION OF THE STATEWIDE ELECTED OFFICIAL;
   (C)  LEGISLATIVE  EMPLOYEES,  INCLUDING  OFFICERS AND EMPLOYEES OF THE
 LEGISLATURE; AND
   (D) LEGISLATIVE MEMBERS, INCLUDING SENATORS AND MEMBERS OF THE  ASSEM-
 BLY.
   § 2. This act shall take effect immediately.
