 AN ACT to amend the public service law, in relation to  requirements  of
   developers  of offshore wind renewable energy projects receiving state
   financial support for such projects
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.   Subdivision 5 of section 66-p of the public service law,
 as added by chapter 106 of the laws of  2019,  is  amended  to  read  as
 follows:
   5. (A) No later than July first, two thousand twenty-four, the commis-
 sion  shall establish programs to require the procurement by the state's
 load serving entities of at least nine gigawatts of offshore wind  elec-
 tricity  generation  by  two  thousand  thirty-five and six gigawatts of
 photovoltaic solar  generation  by  two  thousand  twenty-five,  and  to
 support  three  gigawatts  of  statewide  energy storage capacity by two
 thousand thirty.
   (B) THE COMMISSION AND THE NEW YORK STATE ENERGY RESEARCH AND DEVELOP-
 MENT AUTHORITY SHALL NOT ENTER INTO ANY CONTRACT OR OTHER AGREEMENT WITH
 A DEVELOPER OF AN OFFSHORE WIND  ELECTRICITY  GENERATION  PROJECT  UNDER
 WHICH  THE  COMMISSION  AND/OR  THE  NEW  YORK STATE ENERGY RESEARCH AND
 DEVELOPMENT AUTHORITY PROVIDE  SUPPORT  FOR  SUCH  PROJECT  THROUGH  THE
 PURCHASE OF RENEWABLE ENERGY CREDITS OR THROUGH ANY OTHER FORM OF FINAN-
 CIAL  SUPPORT,  UNLESS  SUCH  DEVELOPER  SHALL  AGREE: (I) THAT THE WIND
 TURBINES AND EQUIPMENT USED IN SUCH PROJECT SHALL  BE  MANUFACTURED  AND
 PRODUCED  IN NEW YORK STATE, TO THE MAXIMUM EXTENT FEASIBLE; AND (II) TO
 PROCURE THE WIND TURBINES AND EQUIPMENT USED  IN  SUCH  PROJECT  FROM  A
 MANUFACTURER  OR  MANUFACTURERS THAT SHALL HAVE A LABOR PEACE AGREEMENT,
 WITH A UNION REPRESENTING THE EMPLOYEES  ENGAGED  IN  SUCH  MANUFACTURE,
 ENSURING THE UNINTERRUPTED SUPPLY OF SUCH WIND TURBINES AND EQUIPMENT.
   § 2. This act shall take effect immediately.
