TITLE OF BILL:

An act to amend the vehicle and traffic law, in relation to the central
business district toll and congestion pricing in New York city

 
PURPOSE:

The purpose of this bill is to tax motorcycles entering the central
business district of New York City at half the rate of their passenger
vehicle peers.

 
SUMMARY OF PROVISIONS:

This legislation amends the underlying chapter by incorporating 50
percent off all motorcycle fares related to congestion pricing in the
City of New York. As entities decide costs associated with the rollout
of congestion pricing, this bill will require that all tolls peak/off
peak, etc. will be half that of their MV/ EV counterparts.

 
JUSTIFICATION:

The argument for reducing the costs associated with congestion pricing
for motorcycles makes a great deal of sense. They take up less space on
roadways, in parking, and are generally more fuel efficient, if not
already electric.

Why should motorcycles be subject to the same toll rate as passenger
vehicles when they are less than or equal to half the size and weight of
said vehicles.

This bill was motivated by motorcyclists in New York City who have occu-
pations that require tools which our laws and norms would consider dead-
ly weapons on our mass transit systems. While a bill could realistically
be written to carve them out with some sort of documentation, in terms
of good public policy a vehicle that proportionally creates less
congestion, it ought to be in our common sense to provide such vehicles
with a discount.

 AN ACT to amend the vehicle and traffic law, in relation to the  central
   business district toll and congestion pricing in New York city
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 1 of section 1704-a of the vehicle and  traffic
 law, as added by section 1 of subpart A of part ZZZ of chapter 59 of the
 laws  of  2019, is amended and a new subdivision 1-a is added to read as
 follows:
   1. Consistent with the goals of reducing traffic congestion within the
 central business district and funding capital  projects  the  Triborough
 bridge  and tunnel authority shall have the power, subject to agreements
 with its bondholders, and applicable federal law to establish and charge
 variable tolls and fees for vehicles, INCLUDING MOTORCYCLES, entering or
 remaining in the central business district at any time  and  shall  have
 the power, subject to agreements with bondholders, and applicable feder-
 al  law  to  make  rules  and  regulations  for  the  establishment  and
 collection of central business district tolls, fees, and other  charges.
 For  purposes  of establishing a central business district toll or tolls
 the board shall, at minimum, ensure annual revenues and  fees  collected
 under  such  program,  less  costs of operation of the same, provide for
 sufficient revenues into the central business district  tolling  capital
 lockbox fund, established pursuant to section five hundred fifty-three-j
 of  the public authorities law necessary to fund fifteen billion dollars
 for capital projects for the 2020 to 2024 MTA capital program,  and  any
 additional  revenues above that amount to be available for any successor
 programs. Additionally, no  toll  may  be  established  and  charged  on
 passenger  vehicles  registered  pursuant  to subdivision six of section
 four hundred one of this chapter more than once per day for purposes  of
 entering the central business district.

   1-A. THE TRIBOROUGH BRIDGE AND TUNNEL AUTHORITY SHALL BE AUTHORIZED TO
 IMPOSE  TOLLS  AND  FEES  FOR  MOTORCYCLES  ENTERING OR REMAINING IN THE
 CENTRAL BUSINESS DISTRICT AT ANY TIME AND SHALL HAVE THE POWER,  SUBJECT
 TO AGREEMENTS WITH BONDHOLDERS, AND APPLICABLE FEDERAL LAW TO MAKE RULES
 AND REGULATIONS FOR THE ESTABLISHMENT AND COLLECTION OF CENTRAL BUSINESS
 DISTRICT  TOLLS,  FEES,  AND OTHER CHARGES. SUCH TOLLS AND FEES SHALL BE
 HALF OF THE CHARGES FOR TOLLS AND FEES OF OTHER VEHICLES.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law. Effective immediately, the addition,  amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation  of  this act on its effective date are authorized to be made and
 completed on or before such effective date.
