BILL NUMBER: S4310 SPONSOR: SEPULVEDA TITLE OF BILL: An act to amend the environmental conservation law, in relation to changing the definition of the word "weed" PURPOSE OR GENERAL IDEA OF BILL: This bill will change the definition of "weed" to target noxious, inva- sive and otherwise harmful plants, but exclude native species and endan- gered species. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends Environmental Conservation Law 33-101(45). Section 2 provides an effective date. JUSTIFICATION:

SEPULVEDA -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to changing the definition of the word "weed" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 45 of section 33-0101 of the environmental conservation law, as added by chapter 685 of the laws of 1978 and as renumbered by chapter 612 of the laws of 1983, is amended to read as follows: 45. "Weed" means any plant [which grows where not wanted] SPECIES DESIGNATED AS NOXIOUS, HARMFUL, EXOTIC, INVASIVE, INJURIOUS OR POISONOUS PURSUANT TO STATE OR FEDERAL LAW, AND SHALL NOT INCLUDE ANY ENDANGERED SPECIES OR ANY PLANTS INDIGENOUS TO THIS STATE. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD08850-01-3
