BILL NUMBER: S4440 SPONSOR: FERNANDEZ TITLE OF BILL: An act to amend the executive law and the mental hygiene law, in relation to establishing a state director of drug policy PURPOSE OR GENERAL IDEA OF BILL: To establish a State Director of Drug Control Policy. SUMMARY OF PROVISIONS: Section 1 amends the executive law to create a Director of Drug Control Policy and outline their duties. Section 2 amends the mental hygiene law to require that one appointment by the Governor to the opioid settlement board be the Director of Drug Control Policy. Section 3 sets the effective date.

FERNANDEZ -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law and the mental hygiene law, in relation to establishing a state director of drug policy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 4-c to read as follows: § 4-C. DIRECTOR OF DRUG CONTROL POLICY. THE GOVERNOR SHALL APPOINT A DIRECTOR OF DRUG CONTROL POLICY FOR THE STATE AND RECEIVE A SALARY TO BE FIXED BY THE GOVERNOR WITHIN THE AMOUNT APPROPRIATED THEREFOR. THE DIRECTOR OF DRUG POLICY'S RESPONSIBILITIES SHALL INCLUDE THE FOLLOWING: 1. LEAD THE STATE DRUG CONTROL EFFORT, INCLUDING COORDINATING WITH THE STATE AGENCIES THAT IMPACT DRUG POLICY AND ASSOCIATED FUNDING; 2. COORDINATE AND OVERSEE THE IMPLEMENTATION OF STATE DRUG POLICY; 3. ASSESS THE ADEQUACY OF THE STATE DRUG CONTROL PROGRAMS AND THE BUDGETS FOR THOSE PROGRAMS; 4. EVALUATE THE EFFECTIVENESS OF STATE DRUG CONTROL POLICY EFFORTS; 5. IDENTIFY AND RESPOND TO EMERGING DRUG THREATS RELATED TO ILLICIT DRUG USE; 6. FACILITATE BROAD-SCALE INFORMATION SHARING AND DATA STANDARDIZATION AMONG STATE AND LOCAL ENTITIES TO SUPPORT THE STATE DRUG CONTROL EFFORTS; 7. ASSIST THE GOVERNOR IN THE ESTABLISHMENT OF POLICIES, GOALS, OBJEC- TIVES, AND PRIORITIES FOR DRUG POLICY; 8. CONSULT WITH AND ASSIST LOCAL GOVERNMENTS WITH RESPECT TO THE FORMULATION AND IMPLEMENTATION OF DRUG CONTROL POLICY; AND 9. SERVE AS AN EX-OFFICIO MEMBER OF THE OPIOID SETTLEMENT BOARD ESTAB- LISHED PURSUANT TO SECTION 25.18 OF THE MENTAL HYGIENE LAW.
