BILL NUMBER: S5294 SPONSOR: FERNANDEZ TITLE OF BILL: An act to amend the education law, in relation to requiring certain persons receive mental health training each year PURPOSE OR GENERAL IDEA OF BILL: To require individuals with certain certificates who teach courses regarding mental health to be trained in the subject. SUMMARY OF PROVISIONS: Section One amends the education law in relation to requiring all educa- tors who hold a level III teaching assistant certificate or certificate in the educational leadership service to receive a minimum of three hours of mental health training per year. Section Two sets the effective date.

FERNANDEZ -- read twice and ordered printed, and when printed to be committed to the Committee on Alcoholism and Substance Use Disorders AN ACT to amend the education law, in relation to requiring certain persons receive mental health training each year THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 804 of the education law is amended by adding a new subdivision 8-a to read as follows: 8-A. ALL HOLDERS OF A PROFESSIONAL CERTIFICATE IN THE CLASSROOM TEACH- ING SERVICE, HOLDERS OF A LEVEL III TEACHING ASSISTANT CERTIFICATE AND HOLDERS OF A PROFESSIONAL CERTIFICATE IN THE EDUCATIONAL LEADERSHIP SERVICE PURSUANT TO PARAGRAPH A OF SUBDIVISION TWO OF SECTION THREE THOUSAND SIX-A OF THIS CHAPTER SHALL RECEIVE A MINIMUM OF THREE HOURS OF TRAINING IN MENTAL HEALTH PER YEAR. THE INSTRUCTIONAL CONTENT OF SUCH TRAINING SHALL BE CONSISTENT WITH MENTAL HEALTH CURRICULUM GUIDELINES ESTABLISHED BY THE COMMISSIONER PURSUANT TO THIS SECTION. § 2.
