TITLE OF BILL:
An act to amend the general construction law, in relation to establish-
ing Eid Ul-Fitr and Eid Ul-Adha as public holidays
PURPOSE:
To establish Eid Ul-Fitr and Eid Ul-Adha, the two Muslim holidays, as
Public Holidays.
SUMMARY OF SPECIFIC PROVISIONS:
Section 1: Section 24 of the general construction law, as amended by
chapter 347 of the laws of 1984, is amended to read as follows: The
holidays of Eid Ul-Fitr and Eid Ul-Adha, as affixed by Muslim religious
law and tradition, are to be Public Holidays.
Section 2: This act shall take effect immediately.

AN ACT to amend the general construction law, in relation to establish-
ing Eid Ul-Fitr and Eid Ul-Adha as public holidays
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 24 of the general construction law, as amended by
chapter 249 of the laws of 2020, is amended to read as follows:
§ 24. Public holidays; half-holidays. The term public holiday includes
the following days in each year: the first day of January, known as New
Year's day; the third Monday of January, known as Dr. Martin Luther
King, Jr. day; the twelfth day of February, known as Lincoln's birthday;
the third Monday in February, known as Washington's birthday; the last
Monday in May, known as Memorial day; the second Sunday in June, known
as Flag day; the nineteenth day of June, known as Juneteenth; the fourth
day of July, known as Independence day; the first Monday in September,
known as Labor day; the second Monday in October, known as Columbus day;
the eleventh day of November, known as Veterans' day; the fourth Thurs-
day in November, known as Thanksgiving day; and the twenty-fifth day of
December, known as Christmas day; THE HOLIDAYS OF EID UL-FITR AND EID
UL-ADHA, AS AFFIXED BY MUSLIM RELIGIOUS LAW AND TRADITION, and if any of
such days except Flag day is Sunday, the next day thereafter; each
general election day, and each day appointed by the president of the
United States or by the governor of this state as a day of general
thanksgiving, general fasting and prayer, or other general religious
observances. The term half-holiday includes the period from noon to
midnight of each Saturday which is not a public holiday.
§ 2. This act shall take effect immediately.

SUMMARY OF PROVISIONS:
Sections 1 and 2 amend education law to add Eid al-Fitr and Eid al-Adha
to the list of days school can not be in session.
Section 3 sets the effective date.

AN ACT to amend the education law, in relation to establishing Eid
al-Fitr and Eid al-Adha as school holidays
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 8 of section 3604 of the education law, as
amended by chapter 359 of the laws of 2023, is amended to read as
follows:
8. No school shall be in session on a Saturday, the first day of the
second lunar month after the winter solstice in the preceding calendar
year known as Asian Lunar New Year, THE HOLIDAYS OF EID AL-FITR AND EID
AL-ADHA, AS AFFIXED BY MUSLIM RELIGIOUS LAW AND TRADITION, or a legal
holiday, except general election day, Washington's birthday and
Lincoln's birthday, and except that driver education classes may be
conducted on a Saturday. A deficiency not exceeding four days during any
school year caused by teachers' attendance upon conferences held by
superintendents of schools of city school districts or other school
districts employing superintendents of schools shall be excused by the
commissioner, notwithstanding any provision of law, rule or regulation
to the contrary, a school district may elect to schedule such conference
days in the last two weeks of August, subject to collective bargaining
requirements pursuant to article fourteen of the civil service law, and
such days shall be counted towards the required one hundred eighty days
