Provides that where mandatory continuing education programs are offered through electronic or other remote means where the licensee must provide proof of attendance by responding to a visual or auditory prompt in the program, such program shall conform to the most recent guidelines for website content accessibility guidelines.

   printed to be committed to the Committee on Higher Education
 
 AN ACT to amend the education law, in relation to  remote  programs  for
   mandatory continuing education
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The education law is amended by adding a new section 6505-e
 to read as follows:
   § 6505-E. REMOTE PROGRAMS FOR  MANDATORY  CONTINUING  EDUCATION.    1.
 WHENEVER  THE  PRACTICE  OF  A PROFESSION WHICH IS LICENSED BY THE STATE
 SHALL REQUIRE THE COMPLETION  OF  MANDATORY  CONTINUING  EDUCATION,  ANY
 PROGRAM  DESIGNED  AND  APPROVED  TO  FULFILL  SUCH REQUIREMENT WHICH IS
 OFFERED TO BE DELIVERED ELECTRONICALLY OR BY OTHER  REMOTE  MEANS  WHERE
 THE  LICENSEE MUST PROVIDE PROOF OF ATTENDANCE BY RESPONDING TO A VISUAL
 OR AUDITORY PROMPT IN THE PROGRAM  SHALL  CONFORM  TO  THE  MOST  RECENT
 GUIDELINES FOR WEBSITE CONTENT ACCESSIBILITY GUIDELINES (WCAG).
   2.  A  CIVIL  PENALTY  OF ONE THOUSAND DOLLARS MAY BE IMPOSED FOR EACH
 VIOLATION OF THIS SECTION.
   § 2. This act shall take effect on the thirtieth day  after  it  shall
 have become a law.
