BILL NUMBER: S6981 SPONSOR: MANNION TITLE OF BILL: An act to amend the education law, in relation to establishing special permits to practice as a clinical laboratory practitioner PURPOSE: The purpose of this bill is to allow the State Education Department to issue a special permit to practice as a clinical laboratory practitioner to an individual who has met all the necessary requirements for licen- sure, besides the examination, for up to 180 days, provided that such individual files an application with the department for licensure. MANNION -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to establishing special permits to practice as a clinical laboratory practitioner THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The section heading of section 8608 of the education law, as amended by chapter 147 of the laws of 2018, is amended to read as follows: Limited [and], provisional AND SPECIAL permits. § 2. Subdivision 3 of section 8608 of the education law is renumbered subdivision 4 and a new subdivision 3 is added to read as follows: 3. SPECIAL PERMIT. (A) THE DEPARTMENT MAY ISSUE A SPECIAL PERMIT TO PRACTICE AS A CLINICAL LABORATORY PRACTITIONER TO AN INDIVIDUAL WHO HAS MET ALL REQUIREMENTS FOR LICENSURE AS A CLINICAL LABORATORY TECHNOLOGIST OR CYTOTECHNOLOGIST, HISTOTECHNOLOGIST, OR CERTIFICATION AS A CLINICAL LABORATORY TECHNICIAN OR HISTOTECHNICIAN, EXCEPT SUCH REQUIREMENTS RELATING TO EXAMINATIONS, AND PROVIDED THAT THE INDIVIDUAL IS UNDER THE GENERAL SUPERVISION OF THE DIRECTOR OF A CLINICAL LABORATORY, AS DETER- MINED BY THE DEPARTMENT. PROVIDED, FURTHER, THAT SUCH INDIVIDUAL SHALL FILE AN APPLICATION WITH THE DEPARTMENT FOR LICENSURE PURSUANT TO SECTION EIGHTY-SIX HUNDRED FIVE, EIGHTY-SIX HUNDRED SIX, EIGHTY-SIX HUNDRED SIX-A OR EIGHTY-SIX HUNDRED SIX-B OF THIS ARTICLE AND FOR THE PERMIT ESTABLISHED BY SUBDIVISION ONE OF THIS SECTION. (B) THIS SPECIAL PERMIT SHALL BE VALID FOR A PERIOD OF NOT MORE THAN ONE HUNDRED EIGHTY DAYS OR UNTIL THE TIME AN APPROPRIATE EXAMINATION IS TAKEN BY THE INDIVIDUAL, WHICHEVER IS LATER, PROVIDED THAT THE SPECIAL LICENSE SHALL BE RENEWABLE ON A FORM PRESCRIBED BY THE DEPARTMENT. (C) EACH SPECIAL PERMIT SHALL BE SUBJECT TO THE DISCIPLINARY PROVISIONS APPLICABLE TO LICENSEES PURSUANT TO SUBARTICLE THREE OF ARTI- CLE ONE HUNDRED THIRTY OF THIS TITLE. § 3.
