 AN ACT to amend the public health law and the environmental conservation
   law, in relation to the remediation of lead contaminated soil
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 206 of the public health law is amended by adding a
 new subdivision 32 to read as follows:
   32. THE COMMISSIONER IN CONSULTATION WITH THE COMMISSIONER OF ENVIRON-
 MENTAL CONSERVATION SHALL REQUIRE THAT AREAS CONTAINING LEAD-CONTAMINAT-
 ED  SOIL  SHALL  HAVE  THE LEVELS OF LEAD CONTAMINATION DECREASED TO THE
 LEVEL OF THREE HUNDRED PPM (PARTS PER  MILLION)  FOR  RESIDENTIAL  ZONED
 AREAS  AND ONE THOUSAND PPM FOR AREAS ZONED FOR COMMERCIAL AND/OR INDUS-
 TRIAL DEVELOPMENT.
   § 2. Subdivision 1 of section 3-0301 of the environmental conservation
 law is amended by adding a new paragraph nn to read as follows:
   NN. REQUIRE, IN CONSULTATION  WITH  THE  COMMISSIONER  OF  HEALTH,  AS
 REQUIRED  BY  SUBDIVISION  THIRTY-TWO  OF SECTION TWO HUNDRED SIX OF THE
 PUBLIC HEALTH LAW, THAT AREAS CONTAINING LEAD-CONTAMINATED SOIL HAVE THE
 LEVELS OF LEAD CONTAMINATION DECREASED TO THE LEVEL OF THREE HUNDRED PPM
 (PARTS PER MILLION) FOR RESIDENTIAL ZONED AREAS AND ONE THOUSAND PPM FOR
 AREAS ZONED FOR COMMERCIAL AND/OR INDUSTRIAL DEVELOPMENT.
   § 3. This act shall take effect on the ninetieth day  after  it  shall
 have become a law. Effective immediately, the addition, amendment and/or
 repeal  of  any  rule  or regulation necessary for the implementation of
 this act on its effective date are authorized to be made  and  completed
 on or before such date.
