Requires the commissioner to promulgate rules and regulations requiring the department to install or cause to be installed at the outlet of any point source that empties into the waters of the state a trash capture net for purposes of collecting garbage, refuse, and other debris; defines "trash capture net" to mean a commercial grade, reusable, open-meshed material designed to capture pollutants as small as five millimeters in diameter.

BILL NUMBER: S7217 SPONSOR: GOUNARDES TITLE OF BILL: An act to amend the environmental conservation law, in relation to the installation of trash capture nets PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to establish installation of trash capture nets over storm drains and their like so as to limit refuse, pollutants and garbage into our State's waters. SUMMARY OF PROVISIONS: The environmental conservation law is amended by adding a new section 17-0832 to read as follows: § 17-0832 requiring the additional require- ment of implementing trash capture nets commercial grade, reusable, open-meshed material as small as five millimeters in diameter designed to capture pollutants and placed over catch basins, storm drains and or any source emptying into a body of water, water way of the State so as

GOUNARDES -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the installation of trash capture nets THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 17-0832 to read as follows: § 17-0832. ADDITIONAL REQUIREMENT; TRASH CAPTURE NETS. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, RULE OR REGULATION, THE COMMISSIONER SHALL PROMULGATE RULES AND REGULATIONS REQUIRING THE DEPARTMENT TO INSTALL OR CAUSE TO BE INSTALLED AT THE OUTLET OF ANY POINT SOURCE THAT EMPTIES INTO ANY WATERS OF THE STATE A TRASH CAPTURE NET FOR PURPOSES OF COLLECTING GARBAGE, REFUSE, AND OTHER DEBRIS. FOR PURPOSES OF THIS SECTION, A "TRASH CAPTURE NET" SHALL MEAN A COMMERCIAL GRADE, REUSABLE, OPEN-MESHED MATERIAL DESIGNED TO CAPTURE POLLUTANTS AS SMALL AS FIVE MILLIMETERS IN DIAMETER. § 2. This act shall take effect on the one hundred twentieth day after it shall have become a law. Effective immediately the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date are authorized to be made and completed on or before such date.
