BILL NUMBER: S7249 SPONSOR: COONEY TITLE OF BILL: An act in relation to requiring a place of entertainment to establish emergency preparedness plans SUMMARY OF PROVISIONS: Section 1 requires all places of entertainment holding at least one thousand people to submit any emergency preparedness plan required by the state's fire code to the municipality to be approved or rejected, as well as include all mandatory announcements required by the fire code. Also establishes fines for failure to comply. Section 2 authorizes the commissioner of the division of homeland secu- rity and emergency services to promulgate rules and regulations neces- sary to carry out the provisions of this act. Section 3 is the effective date.

COONEY -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Securi- ty and Military Affairs AN ACT in relation to requiring a place of entertainment to establish emergency preparedness plans THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Emergency preparedness plans. 1. a. Any place of enter- tainment, as such term is defined in section 25.03 of the arts and cultural affairs law, that is open for use and can hold at least one thousand people shall submit to the municipality in which such place of entertainment is located an emergency preparedness plan. For purposes of this section, "emergency preparedness plan" shall mean any fire safety or evacuation plan required by the most recent fire code adopted by the state. b. Such emergency preparedness plan shall be submitted to the munici- pality on an annual basis. The municipality shall approve or reject such plan. Any place of entertainment subject to the provisions of this act that fails to submit such plan shall not host events until such plan is submitted and approved. If a municipality fails to approve or reject such plan within thirty days it shall be deemed approved. c. Any place of entertainment subject to the provisions of this section that fails to submit such plan shall also be subject to a fine of one thousand dollars for the first violation and five thousand dollars for each subsequent offense. Such fine is to be paid to the municipality in which such place of entertainment is located. 2. Any place of entertainment, as such term is defined in section 25.03 of the arts and cultural affairs law, that is open for use shall make all emergency announcements as required by the most recent fire code adopted by the state.
