TITLE OF BILL:

An act to amend the agriculture and markets law, in relation to supple-
mental labeling for treated seeds

 
PURPOSE OF THE BILL:

To update the Agriculture and Markets Law (AML) labeling requirements
for treated seeds (AML §§ 136 and 137) to reflect modern seed treatment
technology, cover current labeling and information delivery practices in
the industry and to address current environmental considerations with
respect to their use,

 
SUMMARY OF PROVISIONS:

A new subparagraph 8-a will be added to AML § 136, providing a defi-
nition for "supplemental labeling" and supplemental labelling require-
ments for treated seeds.  Paragraph 3 of Subdivision A of AML § 137 will
be amended to broaden the requirements for labeling to cover off target

organisms and other potential environmental impacts, the form and
content of which shall be approved by the commissioner. The current
statute only requires the warnings related to the risk of product use
for humans and other vertebrates.

Sub-paragraph A of AML § 137 will be amended by adding a new paragraph 4
which requires sellers of commercial quantities of treated seed to main-
tain a record of any supplemental labeling for a period of three years.

 
JUSTIFICATION:

Seed treatments are a valuable tool for our agricultural industry. Due
to increased introductions of invasive species and the advance of
climate change, seed treatments are likely to become an even more impor-
tant management tool for our agricultural industry in the future. Howev-
er, as the risks presented by overuse or misuse with respect to humans,
other vertebrates, invertebrates, and the environment are better under-
stood, the department requires broadened authority to provide robust
warning statements and adequate instructions for the use of treated
seeds. This authority will help the department better protect the
public, those using treated seed and the environment when the use of
treated seed is necessary.

 
PRIOR LEGISLATIVE HISTORY:

The seed law has been updated several times, but this is a new proposal;
there have been no similar proposals.

 
FISCAL IMPLICATIONS:

This bill has limited fiscal implications for the department. The
department may need to provide training to seed companies and may need
to seek outside expertise in the development of sample labels, warning
statements and other instructions for the safe use of treated seeds. The
Integrated Pest Management Program and other components of the land
grant system may be able to assist with developing these resources.

 
EFFECTIVE DATE:
This act shall take effect on the one hundred eightieth day after it
shall have become a law.

 AN  ACT to amend the agriculture and markets law, in relation to supple-
   mental labeling for treated seeds

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section 136 of the agriculture and markets law is amended
 by adding a new subdivision 8-a to read as follows:
   8-A. THE TERM "SUPPLEMENTAL LABELING" REFERS TO  INFORMATION  THAT  IS
 REQUIRED  TO  BE  SUPPLIED TO THE END USER OF AGRICULTURAL AND VEGETABLE
 SEED WHEN SOLD OR OTHERWISE EXCHANGED IN  COMMERCIAL  QUANTITIES,  WHICH
 MAY  INCLUDE,  AMONG OTHER THINGS, INSTRUCTIONS AND WARNINGS INTENDED TO
 SAFEGUARD END USER HEALTH, PUBLIC HEALTH AND/OR THE GENERAL  QUALITY  OF
 THE  ENVIRONMENT,  INCLUDING  WATER  QUALITY  AND  THE PROTECTION OF OFF
 TARGET ORGANISMS AND SITES. SUPPLEMENTAL LABELING NEED NOT  BE  ATTACHED
 TO  THE  SEED  CONTAINER,  AND MAY TAKE THE FORM OF, AMONG OTHER THINGS,
 PACKAGE INSERTS, INFORMATION SHEETS, INFORMATION DISPLAYS OR OTHER MEANS
 OF COMMUNICATION, APPROVED BY THE COMMISSIONER.
   § 2. Paragraph 3 of subdivision A of section 137  of  the  agriculture
 and markets law, as added by chapter 631 of the laws of 1955, is amended
 to read as follows:
   3.  If  seed  has  received  an  application of a substance harmful to
 humans [or], other vertebrates OR THAT MAY NEGATIVELY IMPACT  THE  ENVI-
 RONMENT  OR  OFF  TARGET  ORGANISMS  in  the  quantities used, a warning
 adequate to protect the [public] HANDLER, END USER AND THE PUBLIC  SHALL
 BE REQUIRED. SUCH WARNING MAY BE INCORPORATED INTO THE SEED PACKAGING OR
 MAY BE SUPPLIED AS A SUPPLEMENTAL LABEL.
   §  3.  Subdivision A of section 137 of the agriculture and markets law
 is amended by adding a new paragraph 4 to read as follows:
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

   4. THE SELLER SHALL  MAINTAIN  A  RECORD  OF  ANY  SUPPLEMENTAL  LABEL
 SUPPLIED FOR SEED SUBJECT TO THE REQUIREMENTS OF PARAGRAPH THREE OF THIS
 SUBDIVISION FOR A PERIOD OF THREE YEARS.
   § 4. This act shall take effect on the one hundred eightieth day after
 it shall have become a law.
